BlackBear Malamutes/Schmersal Kevin Schmersal, Patti Schmersal, Lebenshunger German Shepards Was sold an Alaskan Malamute with Parvovirus (fatal in most dogs). He was under quarantine when we chose the dog and when the dog was delivered. Bangor, Maine

On January 25, 2011, my husband and I chose a Giant Red Alaskan Malamute puppy from a litter born on Jan. 8, 2011, for my birthday gift. We went to Bangor and gave Patti and Kevin a cash deposit for the dog of $1000 to be sure she would be ours in March. Come March, the puppy (that will eventually be about 115 lbs.) was very small and very sick when Patti dropped her off to us.

Patti said the car ride was really hard on here, just give her plain yogurt and cottage cheese and she will be fine. This was a Sunday night, the car ride home was terrible, the first night was also terrible, very sick puppy. On Monday I called my local vet and she didn't think anything was really wrong, to just keep the appt. we had scheduled for Tuesday morning. She went to the vet, still sick, but doc wasn't very concerned (the puppy came from a reputal breeder).

On Wednesday night at 8:00 PM, Patti Schmersal called us and told us that another puppy in the litter had been diagnosed with Parvovirus. Not knowing what this was, I did research and called my vet at home that night. Brought the puppy to her on Thursday where she was hospitalized for the day and they tried their best to rehydrate her. Had to take her home on Thurs. night (vet is not overnight ready), and back in the morning. All day at the vet on friday and to the emergency animal hospital we went. She was hospitalized and quarantined there for 6 days.

Emerald was lucky and made it. We have a wonderful dog now. We brought the Schmersal's to court today (1/30/12), and basically lost. We will get back 1/2 of our purchase price and nothing more. The bills amounted to more than $3000. The dog cost us $1800. The other puppies also had Parvovirus and we know that 2 others are living, but the remaining 2 we are unaware. The law lets criminals get away these things, the quarantines don't matter and the only way to know if a kennel is under quarantine is to call animal control in your state. These people are the biggest scam artists going. Be very careful if you decide to deal with them.

Close to resolution

After the birth of 4 healthy pups, I would agree with the breeder that I may have over reacted. I hope to receive the AKC papers for the female soon, as he has promised to send them immediately.

It seems that cooler heads have (hopefully) prevailed. It looks like our original contract may be honored and to his credit since the female was paid for six weeks ago, several weeks after i posted my initial report, he did in fact agree to reduce the price of the male if the female wasn't pregnant. She was in fact pregnant, so I think the gesture speaks volumes about the breeder's willingness to negotiate.

I would like to publicly apologize for suggesting that he would lie about the female being pregnant. The information I had about due date was fuzzy and I overreacted.

Having said all of that we are both acting on Faith that this thing will come to quickly come to a successfull and amicable resolution. .

In spite of all the water under the bridge I do in fact have two wonderful dogs and we have obviously fallen in love with them.

I will post here with further updates and confirm receipt of the AKC papers and successfull registration of the litter once that occurs.

I have no interest in being a crusader here or elsewhere against these guys if the are going to be true to their word.

If the contract and agreement is honored by the breeder I will immediately post a full retraction here in fairness to the breeder.

I found this site after an attorney did some cusory investigating into this guy and sent me some links.

If you do a thorough internet search using this breeder's name (unfortunately i never did) you will find numerous allegations: ranging from various possible frauds, alleged involvement in assault, arrest for possible disorderly conduct discussions of running a puppy mill, allegations that he hired contractor's to complete home improvement projectS and then didn't pay them as agreed. Selling possibly abused or neglected dogs. One person alleges that this guy basically stole some kimd of trailer from him after paying only half of what was owed. The list goes on and on...

I agreed to buy a pregnant female from this guy and a male as well (the seller insisted that we fly her out right away as she was due to have a litter of pups) for thousands of dollars. I did ask if it was okay yo fly a pregnant dog at her stage of pregnancy, and the seller said yes and that he had been a breeder for 15 years. Although I personally paid this guy over $4600 (because the female had, "$5k to $8k worth of pups" so i'd have to pay several thousand more fore her) and an additional $1000 for shipping. I wanted my little girls to experience the joys of the birthing and raising of puppies so i reluctantly agreed).

The problems started almost immediately. He dropped of the dog in a kennel that was 2 sizes too big for the dog he used a type 700 container where a licensed vet suggested that a type 600 would have been sufficient and possibly even a type 500 could have been used. The plane could only accomadate a type 600. (for the WellCare of the dog if I or the licensed vet(s) that have treated these unhealthy and neglected dogs suggested that a type 700 container was needed I would not comment here or have a problem with it).

Before the plane left I get this overly melo dramatic phone call from the seller saying that, "There was a mechanical issue with the plane and the dogs didn't make the flight". After a quick phone call to the airline I find that the seller lied about (1) the size of the kennel, (2) there was no mechanical problem. The dogs didn't make the flight because the kennel was too big and they couldn't fit in the door.

Because he used the wrong container I had to rent a truck and drive over 5 hours to Atlanta to pick up the dogs as that's the closest they could get.

I then had to pay $175 to have an off work vet assistant pick the dogs up and keep them two nights in her employers clinic. The following morning a very distraught licensed vet (owner of the. clinic) called me to say that the dogs were unhealthy with Giardia. The dogs had severe diarea. She also complained that the dogs were very dirty, with matted hair. This is a licensed vet. She was literally beside herself.

When the seller was. Confronted, calmly, and rationally, he became irate saying that the vet was lying and that the she was manufacturing a lie about him. He went on to say that he had never had any dogs infected with this parasite blah blah blah. (The vet had never met the seller and had no previous knowledge of him and absolutely no motivation to lie). I found out yesterday that the seller has allegedly lost his license because of parvovirus and guess what else? GIARDIA!!!!

Well after picking the dogs up I could see that they were covered in feces from the diarea and needed an immediate bath. There coats we're so severely matted that they even had dread locks. The dogs also had numerous ticks.

I was beside myself so I of course shaved the female completely only to reveal a very unpregnant dog. I then caller the seller and very calmly raised the issue that she was not pregnant. The seller had obviously been expecting this call because I hadn't even finished the sentence and he interrupted me and started screaming at me he called me an s****.>
