June 2012, I filed a sexual harassment complaint and other theft related complaint with Michael Steinberg, HR manager against a fellow employee. The allegations were investigated, eye witnesses confirmed and the store admitted to disciplining the offending associate (a top seller). In addition, the same day, I confronted the offending associate regarding a "stolen" sale, they subsequently made up for, by ringing some of their sales in my name. (Essentially an admission of guilt) After days of investigating (while I was off without pay), Michael Steinberg refused to transfer me or the other associate to another dept or store. (which I was willing to do to avoid any further contact with this employee)
When I filed for unemployment, it was denied and the store denied my harassment claim and stated I "left to pursue personal business".

After I hired an attorney I received a second letter stating I had "abandon my job". So which is it?  I have been advised to file a claim with the EEOC. In a similar incident with two other associates, the offending associate (an hourly worker from the operations side) was terminated. Another Associate I know was terminated without even being notified they were terminated, again, for reporting a top selling associate.

Series of events with a bully

There were a series of events which were all reported at once, shortly after they occurred. 

The person was a bully, unreliable as a coworker and unprofessional, they put their hands on me and attempted to steal a sale. Just because they are a top producer (with questionable methods), they should not be treated any differently than the hourly worker who was terminated for the same type of behavior. I requested a transfer to another dept or store and was denied.

You go from them refusing to transfer you or the other employee, to you being denied for unemployment.  It sure seems like there is some very important information you are leaving out.

Oh and if it has anything to do with you being in fear of this person..that is going to be hard to maintain that claim with a straight face.  After all by your own admission the same day you filed the HR complaint..you actually confronted the employee on something else.  Not exactly the actions of someone in fear.
