Mr. Hodossy,  (Service Director)

 

Apparently,  I had misspelled your last name hence why the e-mail I sent to multiple people both in Morristown and the BMW Corporate office in Woodcliff Lakesand/or Westwood NJ. I have had it with you people and now have consulted with my family lawyer as well as lawyers provided to it's union members like myself. I REFUSE to keep this pile of junk you sold me on my property hardly being able to use a do called certified car I bought from Mark Bonnano and Max across the street. After an hour drive on a highway I now notice an oil burning odor inside the car. Since you and your team FAIL to honor my warranty, TROUBLESHOOT and fix these "additional" problems, give me my 2nd ignition KEY I still never received, as well as, the flimsy tool set that I also discovered I never got with the car coincidently after my son needed it when they came to tow his BMW for service, apparently there is item among that tool set that is needed when winching and flatbedding a BMW. 

 So, the list goes on and on eith this car. The whining noise which a service advisor "Chris" that incidently worked both for you and Art at BMW in Roxbury that just so happens to come to my house with the GC that will be remodeling our bathroom. He said who owns the black beamer because I worked there for 13 yrs. Small world. I told him I am probably going to wind up in a legal battle with them and when I'm done it's gonna cost them more than the $27000 it cost me for this problematic car which  again corporate called me and the girl was adamant about them wanting and preferring to buy the car back, yet no action was ever taken all this time since they repeatedly told me rather than trying to fix the nain issue at the time we'd rather buy the vehicle back. I never heard fron Rebecca nor the other girl from corporate,  Tina I believe, after that conversation back in April or even May?  about how to proceed with returning the vehicle!! Now you will have a fight on your hands I assure you. I will also add additional charges to any civil suit I bring forth if you do not take this car and FIX EVERY issue on it immediately.   My trans is even shifting late and appears to be slipping intermittently now too. Maybe the reason for the burning smell after the car has been running. No more games with you people,  I have a freakin active warranty let alone the CPO EXTENDED WARRANTY and you will not let me bring the car in for service and troubleshooting the new issues now too. I would KEEP tge car if you did your job and honor the warranty and customer complaints as you should. I am done. If this car is NOT picked up by the end of the week, I am willing to part with a retainer for the attorney I go with and don't worry get every cent I lay out for this car. I have every email that proves I notified you repeatedly and my wife as a witness to the calls from corporate. In addition to my son's BMW mechanic that will testify that the initial issue with the whining noise is far from normal and goes away when he removes the serpentine belt, let alone the new issues I have and you FAIL to address them. I won't let up until you either repair these defects and give me my 2nd key I never got from the salesman Mark Bonnano as well as a tool set that is "suppose" to come with EVERY BMW.

 Apparently I am not the only one who has a complaint with BMW NA and also the crooked DEALERSHIP at OPEN ROAD in Morristown who sold me this SUBSTANDARD 2011 328i with too many issues, that I refuse as the buyer, to accept. I opted for repair even now of the additional issues with the trans not shifting correctly and I feel an intermittent slipping when driving local and either starting from a stopped position like at a light but more so when in 1st gear or 2nd I feel a slip before it goes into the next gear. Also an oil burning odor "in the car" AFTER an hour or more of driving on a highway as if oil or trans fluid is burning or dripping on the hot engine manifold ot exhaust?To add injury to insult I never received a 2nd key for the car by Mark Bonnano as promised nor was a tool set present in my trunk as is in every 328i.  

Even if you finally RESUMED service on this car, as you should have since the initial mechanical I've complained about since I got the car home and took notice of it while in the car with the windows up and  the very noticable ABNORMAL whining noise that REMAINS despite the replacement of only "3 minor suspected parts,  then the service  director "Steve Hodessy"and even a corporate field engineer corporate sent out,  has the audacity to say he hears the whinning noise but in his supposed UNBIASED opinion, is normal, which is not the case or ALL CERTIFIED BMW 328i's "EXACTLY LIKE MINE THAT I TESTED, WOULD DO IT.  THEY DON'T! 

Fact is THE WARRANTY requires the dealership to FURTHER troubleshoot and evaluate and CONTINUE to investigate the noise and now the additional issues but the MORRISTOWN DEALERSHIP, ( OPEN ROAD) AND NOW EVEN CORPORATE,  IN WOODCLIFF LAKES NJ NO LESS, HAS DENIED FURTHER SERVICE OR THE REPLACING OF ADDITIONAL SUSPECT PARTS LIKE THE WATER PUMP, OTHER PULLY ASSEMBLIES,  ETC.. THAT ARE ALL DRIVEN BY THE SERPINTINE BELT "WHICH WHEN REMOVED BY MY INDEPENDENT BMW MECHANIC, AND THE CAR IS STARTED" THE INITIAL PROBLEM GOES AWAY!! WHY DON'T THEY GET IT?  This is absurd and I will not relent until the car is either taken in for further troubleshooting USING the simple process of elimination which may REVEAL the cause and component and/or part CAUSING this whinning noise. 

I REFUSE to continue to sit back after spending $27000 of my hard earned money on this problematic vehicle that absurdly that outrageously the dealership refuses to continue service on, especially, now with these NEW issues. The alternative that CORPORATE offered me was a complete REFUND several times since I bought the car but oddly enough NEVER PROCEEDED with the buy-back either. If you are NOT willing to honor the warranty and make ample attempts to look into and hopefully  fix these issues, I purposely haven't driven the car much at all since I bought it in over 6 month's ago!!! This is a travesty of corruption and injustice.  BMW should SERVICE this car OR buy it back like THEY stated they would and eagerly wanted to when they called me at home. A $27000 CAR  THAT SHOULD HAVE NEVER BEEN CERTIFIED,  SITS IN MY DRIVEWAY MORE THAN IT IS DRIVEN. THIS IS AN OUTRAGE. A MILLION PEOPLE WILL HAVE SEEN MY COMPLAINT AND HEAR MY STORY.
