I am a former employee of Subway in Waxahachie that was owned by Bopb Suarez. In the time i was there I seen first hand many safety issues that needed to be addressed.

One of the main issues was with the drive thru ice machine. It leaked all over the main floor and was obviously a safety hazzard. The manager was aware of it and so was corporate Subway, as noted in their compliance report. long story short, I slipped and fell one day in the store and injured my shoulder.

My shoulder was so hurt I couldn't even lift my kids. I missed several weeks of work, was in constant pain, and had to be under doctors care for a while. When I contacted Bob Suarez about the injury he shrugged it off and told me to "take a few days off and a few Excederin". When I told him a doctor suggested I get an MRI, he replied that doctors were all quacks just trying to get money and that he'd had many falls and was okay himself, so there was no reason why I shouldn't be okay as well.

Well as a piano player and a father, not having use of my arm was a major concern for me. I had to seek out an attorney to be able to see the right doctors, and have filed suit against "Bob". Problem is he is hiding from this suit. He has been served , but no one seems to know where he is or how to get in touch with him. My attorney has sent me a letter stating she is ready to file Notice of Nonsuit because she cant get ahold of him.

I think this really is unfair. I still hurt to this day when I do anything for an extende amount of time( 15-20 minutes tops). Some nights I dont sleep well because of shoulder pain, and had difficulty working at other places because of the same pain. So since I am the "little guy" and not well off, I should just suck it up, deal with my pain and losses, and let Bob go on about his business? This guy dosen't care about anything but the almighty dollar, and it isn't right.

I don't know what I'm entitled to or what I deserve, but I want justice for this. Here it is almost 4 yrs later and there is still no resolution. If someone can help me please let me know. Any advice or support would be appreciated.

I am now a former emplyee of bobrich enterprises at the new subway in downtown carrollton. the subway is located just across I35 from the corprate office. just above the subway is soon to be the new corprate office. if you are looking for bob you will find him there during the day. not everyday but alot of the time.

I was just fired from the subway there today from a very rude mannager. Penny Jones. She had a new mannager that hasnt been there for a week. call me over the phone and tell me that i was "no longer required". now mind you in about july the former mannager in the new mannagers position was fired by penny for unknown reasons. with in that same week several emplyees quit because they could not stand to work for penny. i cant stand to work for her either but i stayed because i needed the job. during that time we all complained to bob the owner that we wanted and needed the mannager back and he never acknolaged our requests. so, i stayed through that. about a week or so the store was robbed. and i was working that day i asked penny if we could close the store because the two of us that were there were tramatised. "NO, we dont close this store" is the responce that i recieved. then she said either i can stay or you can stay. I stayed with another employee. After that event i had feer of working there by my self. and she said "well as a closer no matter you close by your self" they have no regard for their employee safty.

 after i was told that i was fired i wanted an explanation to that and something else. so i went up there to ask. i started out " first off i was wanting to know why the money was.." penny very rudely cut me off "no i said im not talking about this any more. is all you need to know is that your survices are no longer requred." then she kept repeating her self. i got up from the table saying " wow just as i thought earlyer" refering to her being a b**ch and treating those under her emplyement like the gum sutck to her shoe.

not long after i left i asked a manager of  the nearby racetrack what he thought of the situation he said that it was very rude what she did. and that i need to ask for it in writing.

after i got to where i needed to be i called the subway again and penny answered. and i asked if i could have in writing what she had said. she said "ravin we are done." and hung the phone up on me. my problem is not with bob but who works in his stores as managers.

how ever if you are still looking for bob. he is there most of the time. during lunch hours.

I worked there. None of this is true.  employee was canned for not coming into work for a week,  angry thats all.  great company

I recently posted a 'Ripoff Report' on here and its pretty much told me what I am already aware of. Bob Suarez is a good for nothing business owner.

I have more than 7 ex-employee's that have been shorted hours, had money taken out of their paychecks for cash shortages and uniforms that they never received. And not to mention some (like myself) never received their last paychecks! I still have 2 that I have not received!

To my thinking, they're are many other employee's out there unaware of this website and the fact that there are many other ex-employee's and employee's out there just like them. It would seem to me if we were able to round up enough people and file a big enough suit, that we just might be able to bring Mr. Suarez down. Possibly out of business?

I realize tining is everything. The second it happened I wasked abvout what the company did in these situations. The manager said they didn't carry any w/c insurance, and by Texas law that was their right. I was treated and did miss work alot following the accident. I do have a lawyer and am well aware of the time it takes in courts to solve these matters, as my accident happened back in 2004. The problem is that this Suarez guy is hiding and hasn't been able to get served. He lies and has his employees lie for him. My attorney is however now getting ready to file a notice of nonsuit because they cant serve the b*&*&, and I think that really sucks. I still hurt if doing anything for any extended amount of time, and that isn't fair to me or my kids. I appreciate your insight though.

You must file a Workers' Compensation report-timing is everything!

You did not indicate when this accident happened, or whether the employer or the corporation has paid for any treatment. Timing is important! You must request that your employer or the corporation file a Workers' Compensation claim. It is illegal in all states for your employer not to carry W/C insurance. An employer who shrugs off an employee injury is breaking the law.

Once the claim has been filed, you will be entitled to a medical assessment, treatment, and meds at the very least. Possibly if you missed work, temporary disability checks as well.

I am not an attorney, so I do not know what the state of Texas allows in regards to W/C. You obviously have a computer, so Google W/C laws in your state. You must research your rights as an injured worker. Knowledge is Power!

In a perfect world it would be better to try to resolve your medical issues without adjudicating. If your employer does not comply with your request, run, do not walk, to an attorney who specializes in this type of law. I am underscoring "specializes in this type of law"! Bear in mind that nothing happens quickly in W/C court, but it will happen eventually.

In the meanwhile also Google the Texas OSHA office. Turn the employer in for as many unsafe working conditions or issues you can remember. Most employers would rather face the devil himself than explain unsafe conditions to OSHA! There a huge fines for violations. You may prevent other employees from having similar injuries.

Been there, done that!
