Laplink, Inc., advertised a $170 rebate in conjunction with a retailer, Fry's Electronics, Inc., for a software purchase. The rebate promised in print that "Rebate checks will be mailed in 10-12 weeks." I complied with all the rebate documentation requirements. This all started on June 19, 2002, when I was living in California. No check has ever been received.

I have contacted the company repeatedly and have been told various things, such as "Your payment is scheduled for the December check run" (it never arrived), and subsequently "...we are currently in a tight cash position...", etc. Meanwhile, while they were months behind in the promise to pay my rebate, they continued to advertise additional rebate offers, and they are still doing so. They presumably are also unwilling or unable to pay those, as well. (See examples of continued rebate advertising at the URLs listed at bottom of this message.)

This seems to be deceptive advertising, and their non-payment seems to be breach of contract. I filed a complaint on February 1, 2003, with the FTC on its Consumer Complaint Form at

but have have heard nothing about it.

All I want is the $170 rebate, as advertised. They have not fulfilled their promise.

Got the following on 6/11/2003 from LapLink:

LapLink Inc., ("LapLink") filed for Chapter 11 bankruptcy protection on March 18, 2003 in the US Bankruptcy Court in Seattle, Case No. 03-13521. In addition we signed an agreement to sell our assets to a third party. The bankruptcy court will consider the proposed sale at a hearing to be scheduled sometime in early May. You will receive notice of this hearing. The sale should be concluded by the middle to latter part of May. The sale will not affect your claim against Laplink. You will receive notice at a later date if it is necessary to file proof of your claim with the Bankruptcy Court. If you have questions, the information may be available on the Bankruptcy Court's website, http://www.wawb.uscourts.gov/.
