Brake Max are liars!!!! tucson, Arizona

Brakemax let my car get towed after they specifically said I could leave it parked there. on 6/27/09, had my car towed into brakemax because it had broke down. They determined that it may need new engine and that prev owner lied about repairs he made. Brakemax parked the car for me since I couldn't afford the repairs and told me I could leave it their while I decided what to do with it. I am currently taking the previous owners to court to get my money back on it. In the mean time, I had called them back and had advised them that I was going to court over it. I asked Stacy (who gave me permission to leave it there in the first place) if it was okay for me to leave it there long term and if there would be any problems with me doing that. She said no. Even though she said she wouldn't recommend leaving it there because of the neighborhood, that Brakemax had no problems with me leaving it there long term. They also have both my phone number and address in their systems so if there was a problem, they could've called me.

Now I've not only been calling in every couple of weeks to check on it and keep them informed, but I've also been driving by to make sure the car was okay. Everything was fine until 2 weeks ago. I drove by there at night only to check on the car only to discover that it was gone. I called Brakemax the next morning to find out what had happened. I spoke with Stacy who gave me permission to leave the vehicle there to begin with. She was completely unaware that it had been towed and even put me on hold so she could run outside and double check on it. She then came back in and informed me that it was gone and that she was not told ahead of time that it would be towed. I was then transferred to Bob who told me that it was towed by the property management company. Spoke with Rudy at the Property Management Company who said they had the vehicle towed and gave me the number to ABC towing. He also said that he had notified Brakemax prior to the vehicle being towed and was told by them that they had called the vehicle owner to advise them of situation. However I've never received a call from them about that.

I have both caller id and voicemail. They never called me at all!! I spoke with Howard at Brakemax customer care both yesterday and today and was informed that Brakemax is not going to do anything!! They claim they have some paperwork I signed that mentions something about their storage policy. I don't remember signing that nor does the paperwork they gave me mention anything about storage there. Nor was anything mentioned about their storage policy when I asked Stacy if I culd leave it there long term. Nor was anything mentioned about it during the several times that I called to check on the car while it was still in their lot. Another thing that I should mention, I found outb this week that the lot THEY parked my car in and told me it was okay to leave my car parked there, is not even owned by them!! I feel that I was misled by Brakemax and they should pay for the towing of my vehicle and the impoundment fees which at this point are going to be over $500!! I'm gonna have to take out a personal loan to do this!!
