I recently left this Company and took another job. They still owe me two weeks wages.

When I transfered stores, some of my uniforms got lost by cintas. I have no way to prove that I don't have them(besides searching my apt) But I would really like some help trying to receive my pay. It sums around 500 dollars. It's not really enough money to call and pay a lawyer for, thats why i was interested in this site.

There is an customer service number but I don't know what it is. The owner of the company is orville. 8 months loyal service and this is how they treat me. This company is unorganized, unskilled and frankly, they are very high priced.

Don't go to brake-o. Go to just brakes. They know what they'r doin!

Responsibility Failure

Dustin: As you know, your check was mailed on June 30th to the LAST KNOWN ADDRESS as indicated on every pay check you had received. On 07/27 a month later, you contacted the office that you had not received the check. The company promptly verified it had not cleared the bank, and had payroll dept re-issue it, sending it priority mail. You also provided a new mailing address at that time to send it.

The office number was printed on all your payroll checks, and posted in every location for our customers. You could have gotten the number at any time to call.

Not only did it take you a month to contact the office delaying your check, it cost the company additionl money for payroll fees to cut the check, postage twice, and the stop payment fees, all due you not providing a current mailing address.

In addition, the uniforms as you know, was your responsibility to keep up with and to return upon termination of employment. You promised Mr. Edwards you would return them to his location along with the air gun you took and did not do so.

Your report is un-called for and certainly indicates your un-willingness to accept simple responsibility, by laying the blame on others.

BRAKE-O AND I HAVE MADE ARRANGMENT. THEY PROMPTLY RESPONDED TO ME. APPARENTLY THEY DID MAIL MY CHECK. I NEVER RECEIVED IT THOUGH. PERHAPS THERE WAS A MAIL MIX UP. THEY WERE VERY COURTIOUS AND PROMPT RESPONDING TO ME. THEY ASSURED ME THE CHECK WOULD BE IN THE MAIL MONDAY. THANK YOU BRAKE-O.

I scoured the Georgia DOL website and can't find a "Wage & Hour Division" or similar entity, which is where you would lodge your complaint in most states.

But try going to the link below and filling in the form with your issue. The DOL should at least be able to lead you in the right direction.

Robert was right: it is illegal for an employer to withhold a paycheck for failure to return a uniform. But this is one of the few legal matters that doesn't require a lawyer to resolve.

Every state has an agency that enforces wage and hour laws. Said agency will resolve your issue free of charge, and possibly levy penalties against your employer as well. Unfortunately, I can't figure out which agency does that in Georgia, so here's that link I was talking about:

Contact the Cintas dealer that seviced your uniforms. Explain to him/her that you turned them in, and have him/her remove the items from the bill. I do it all the time when an employee quits and doesn't bring them back.

Contact your State Labor Board and explain the issue to them also. You'll get your paychecks with no deduction for the uniforms.

If you have been shortchanged by your employer, file a complaint with the state agency that handles unemployment. They'll have a div for such disputes and have the authority to enforce payment of wages. Why you've waited so long is a mystery to me. Time is an enemy when dealing with a scumbag boss. Good luck.
