My husband opened an account at BB&T around December. We encountered our first problem with the bank around. January or February. My husband set up overdraft protection when the account was opened.There was only supposed to be 1 deduction from the checking account to the savings account per month.
They ended up taking 2 deductions in the month. That plus the purchases we made put the account in the negative. When we went to get it straightened out the representative was very rude and basically said it was our fault for going over and not paying attention. The money was supposed to be taken from the savings in the event of ann overdraft. and what we spent would have been covered.
Not only did they not set up the overdarft on the account but they charged in advance for the pending charges. We had to go to another bank to get someone to look at the account. All the money was refunded then.
Recently, We've made purchases that should have been covered by the money that was in our account. The only thing that would have caused an overdraft would have been a $20.00 purchase which would bring the account negative only $8.75. They charged us $280.00 in overdraft fees for all of the small purchases that were made. We only deserved 1 of those overdraft fees.
I did the math and took it to the bank with my husband to show them the error. They told me that the other charges were because money was pending on the account. Pending transactions have nothing to do with anything because all of the charges are cleared by now. Even with the pending charges the account still would have only been negative $8.75.
The overdraft should have only been charged to the most recently cleared transaction. We cannot afford to give away our hard earned money. We have a baby on the way and my husband was just laid off. Shame on BB&T for stealing money from people in need at a time where the economy is in such bad shape. It's bad either way but they are already making the big bucks.

You can't spend money that you don't have. I have a checking account and I DO NOT write checks and I never let it get below certain dollar amount so that I have a buffer to prevent an overdraft. My ex-wife NEVER learned that lesson and that is why she has several hot check warrants out for her arrest right now.

The courts aren't proceeding with anything. The case you cite with the text you added was the judge's ruling in simply deciding not to summarily throw the case out of court. There was a very low possibility that would have ever happened regardless of the situation and the signal from the court was not the bank was not right, but to try and reach a settlement with the client. In this case, the client did reach a settlement with the bank - probably better for the attorneys involved than it was for the White's - that much I can assure you.
Each bank is reaching their own settlement and once settled will absolve them of any future responsibility to future cases. Accordingly, most banks have already either won such cases, or settled the case from long ago - making any future law suit irrelevant and moot. Suing now is a waste of time and money because the White's (for example) went YEARS and YEARS before they saw anything back and it was for a fraction of what they lost. Don't be an apologist for people who can't manage their finances - that is as obscene as performing th actual mismanagement.

You defenders of BB&T just stop with your petty arguments. You provide a themble of evidence to support your argument in a sea of evidence that discredits you. BB&T clearly resequences debits and credits to manipulate and artificially create overdrafts. The courts are finally addressing this issue. The court in White v. Wachovia held; The court cannot find as a matter of law that the Deposit Agreement's statement that Wachovia may post items in any order expressly gives Wachovia the right to manipulate transactions, delay posting indefinitely, and maximize overdraft fees in the ways the Complaint alleges. See Hunting Aircraft, 281 Ga. App. at 452, 636 S.E.2d at 141. (Good faith' and reasonableness' do not comprehend arbitrary or capricious reasons, or considerations based on pecuniary gain, or merely personal preferences; rather, they refer to considerations of fairness and commercial reasonableness.') (citation and internal quotations omitted). People like Steve are idiots and work for BB&T. He uses scare tactics to discourage people to file a lawsuit against BB&T by claiming they will have to spend millions of dollars of their own money to initiate such an action. He does not know that most attorneys take class actions on a contengient basis. Hopefully , you will understand that this is not about manageing a check book, but rather about a bank intentionally delaying posting transactions and creating artificial overdrafts.

How people just don't seem to understand that you cannot spend more money than you have.
Yes, BB&T has organized their company in a way that maximizes their profits when you make a mistake - but you are given and sign those policies when you set up an account.
Do I think it's awesome - No! In many ways it's counter-intuitive and it ends up costing people money who can't afford it.
Do I think that means that someone needs to regulate these practices? - Absolutely not. You acknowledged and accepted BB&T and their policies when you got the account.
Sorry about your luck, but this isn't the bank's problem.

If you really believe that BB&T stole your money, file a criminal theft complaint.
And, don't use your debit card for very small, day to day purchases like a drink, gum, fast food, etc. This is just asking for trouble. Keep a small amount of cash on you for those small purchases. And/or use a credit card, then make payments to it with your online banking a few times per month in between pending deposits.
It simply amazes me how many people cannot grasp such a simple task of maintaining a checking account!
Banks do not cause NSF fees, irresponsible and/or lazy customers do.
You are either not keeping an ACCURATE checkbook register, or you are not waiting for funds to be posted to and available in your account for use.

I too have been a victim of BB&T's. I live in Swansboro, NC and on three seperate incidents have had overdraft fees applied to my account that BB&T could not explain. The first one for a total of $105.00 in fees ended up being refunded as well as the second for $305.00 in overdraft fees. I had to go to BB&T and fight to get them back. Now I find myself a victim for the third time. this time for $385.00 and also they are not refunding the overdraft fees. I keep a ledger, not just a check register, but a ledger as an account would use to do book work. I do not understand how they can tell me that I had $517.00 in my account on saturday, I made a $16.05 purchase and then they charge me a $35.00 on monday. I am leaving BB&T and going to the state employees credit union. I have a family to support and can not keep dealing with BB&T stealing money. I would be interested to know if anyone considered filing a lawsuit, I would be interested to join and help.

BB&T Overdraft Rip-off Update

After returning to the bank and speaking to three different tellers. My husband and I were told the overdrafts were beacause the money was on hold and the following day when the items went to clear instead of subtracting the items from the money that was in hold to pay for them they added them to the negative balance.
This allowed them to add the overdraft fees and then they subtracted the items from the money that was on hold, leaving us with the overdraft fees on the account. This has to be fraudulent. This is there way to swindle money from there customers under the radar. I am reporting BB&T to the bank. They are not walking away with our hard earned money.
Someone needs to regulate what banks are allowed to do more closely.
