brandsmartusa used, returned item sold as new west palm beach , Florida

On 5/24/11 I went to brandsmart to purchase my wife a tablet computer for her birthday. I was told by the salesman Joe LaRose that the one I wanted was out of stock except for one they had with an open box. I was assured that the item was new and unused but because the box seal was broken I would get a discount. I purchased the tablet with my Brandsmart charge card and gave it to my wife for her birthday. We. charged the battery over night and the next day discovered that there were numerous pictures and downloads in the memory. The pictures were tagged 4/17/11 through 4/25/11. There were also several books downloaded into the reader. We were still okay with it until we tried to play a video and the screen was covered with pop ups. It was impossible to watch a video. I now knew why the previous owner had returned it. On 5/25/11 I called Brandsmart. They said the shipment will be in today, bring it in for a replacement. I went to the store, but the units were not on the shipment so they gave me a full credit. Today I made my 3rd trip to Brandsmart and my card was declined because they hadn't processed the credit yet. As of this writing I have been lied to, had funds witheld, made 3 one hour trips to this store and have failed to get a birthday gift for my wife.
