My son just turned 16 years old, and has no previous record of any criminal records. About 5-6 months ago, he has missed some school, which I submitted doctors excuses for him, and Judge Jozwiaks in Alvin, Texas, and Jennifer Skoroki, assistant principal of Alvin High School ignored these valid excuses, therefore, he was put in detention almost the entire year, so he is to repeat the 9th grade, as in these detention programs, there is no teacher to teach these children, just left to sit there and count tiles on ceiling. He was tested for drug use at the Judges office, and found to be drug free. Last Nov. or Dec. 2005, the kids were at a school dance at the Alvin Junior High, when my son's friend wanted to fight another boy there, so a girl went in the gym to get the other boy, who by the way had threatened to have my son's friend killed.

The boy went to the football field with every intention of fighting my son's friend. A witness told me that the boy came out of the gym, came up to my son and hit him. However, my son said that the two boys were fighting, and that he tried to break it up because it was getting bad, and that the other boy hit him, and he hit back. 3-4 months later, the boy that came out of the gym to fight filed assault charges against my son, which was unusual, since the small fight happened so long ago, but the Alvin Police Department accepted the assault charges from him.

I took my son to the police station, where they handcuffed him, and took him at night to the Brazoria County Detention Facility. He stayed overnight, and I picked him up the next morning. He had orders of release which were normal, follow the rules type of orders.

My son got in no trouble from the orders of release in March 2006-August 3, 2006. My son's aunt had rented a beach house for a week for his birthday, and we had gone to court several times to appear before Judge Marc Holder in Angleton Texas, however, he denied me a court appointed attorney, with no explanation. Finally, he appointed Mr. Scott Brown, who is a very nice man, but for some reason has no ambition to win the case. We visted his office a few days before the court date, and at that time he had no paperwork on the case, knew nothing about the case, except what my son told him. This was unusual also, and I didn't understand why he didn't have court documents before hand so he could defend my son.

This is a twisted story, and very hard to explain, as so many corrupted people are involved, and I am not sure why, maybe money, power, or both. My son has a girlfriend who a long time ago, skipped school with some boy, and had Vicodin in her possession.

My son had just met her, and was no part of this. She was put on probation with Mr. Enrique Franco at the Brazoria County Juvenile Detention Center. We had invited his girlfriend to the family beach house, and she had asked her probation officer if she could stay the night. There was over 8-9 adults, and just a few kids, who were fishing, swimming, and totally supervised.

The probation officer, Mr. Franco said okay. We were scheduled to appear in court on August 3, 2006, and Leticia Rodriguez who is a supervisor probation officer, who by the way drives a Lexus, or so I heard, was may mean nothing, however, it may also mean that the taxpayers of Texas may be helping in this area. We appeared in court, only to learn that Mr. Scott Brown had not seen our case, nor studied the case, which was strange. Also, when we had seen him in his office, he talked about losing the case, and what the terms would be to settle with the D.A. I always thought that an attorney was suppose to win, or at least try. Once we were at the court house, and checked in, Mr. Franco came up to my son, or called his name as he didn't know my son, with a urine cup for a drug test. My son's probation officer, Melissa Heinkens was on maternity leave, so I was suprised that he was doing a drug test, when the actual probation officer should have ordered the test, and she wasn't there. We waited for a long time, with 3 trips to the bathroom.

My son had just gone pee pee, and was sick to his stomach. I went to get him a drink, so the test could be done. Our lawyer was bouncing from one court room to another, and still did not have the paperwork for our case, so he still knew nothing about the case. He never once defended my son, and not once did he ask why Mr. Franco was doing a drug test for an assault case. So, Mr. Franco came out of the bathroom with a look of excitement, test in hand, and my son in tears, or trying not to cry. He said that Mr. Franco said that he tested positive for Marijuana, Xanax, Cocaine, and Crystal-meth. My son told me that he has never even seen Cocain, or crystal meth. I told Mr. Franco that the test was wrong, and to do the test again. Mr. Franco said, he is just positive for Marijuana, and xanax. This was Mr. Franco's way of seeing that the girlfriend didn't attend the beach house week with our family when he could have just said no, you can't go. My son told me that Mr. Franco had told his girlfriend, and other children that he didn't like my son, and that he was going to get him. Well, he set him up, and we went before Judge Marc Holder, and he turned it into a detention hearing for failing the drug test, instead of the assault hearing. He sentenced my son to 10 days in jail, which he should have gotten out yesterday, as that was exactly 10 days. However, I suppose they want the State of Texas to pay more money, because they are trying to hold him until Aug. 14th, and possible Aug. 31, 2006, and than possibly put him in boot camp. Not because of him, but because I have called them, and written them so much.

They are punishing him, which isn't fair. He had pink eye a few weeks ago, and was locked in a cell, not to come out for the pink eye. Most all children in the facility are getting out within 3-5 days when sentenced longer, when they have a history of drug use, drug possession, burglary, rape, etc.... Leticia Rodriguez says that every case is different, and my son's history is taken into consideration. He has No history. When we went before Judge Marc Holder, he said that my son had been before him before for drug charges, which is not true. You should see the Juveniles in the court house on court day. I can't believe the cases that he sees/hears. I even wrote him, and asked him to check the records to make sure it was correct, and I heard nothing back. Something is wrong with Angleton/Alvin Texas. If my son has tried drugs, or used drugs, he should be punished, however, he has served his time, if the drug test is correct.

Our lawyer just said "I Object" twice while in the court room. Not another word. Something is wrong here. Even the statements of witnesses to the assault are incorrect. I need help getting my son out of jail, he is suppose to be in school, and I can't get him a fresh start. School started Aug. 9th.

I don't understand why they say education is important, but they won't put my child in a classroom, or let him out after 10 days, so I can get him in school. The Juveniles have very little priviledges. Visiting hours 1 day per week, Saturdays, 8-12, for one hour only. They can purchase nothing.

They can only call out Tuesdays, and Fridays, and when the calls don't go through, the probation officer is suppose to take them to another phone to put in a pin number so they can call home, however, they aren't doing that.

My son has been trying to call home since Aug. 3rd, and it won't go through. Immediate family can visit only, and if you don't have an ID, you can't visit. Example, my daughter wanted to see her brother last Saturday, and even though I am her mother, and I had an ID, she is 20 years old, and lost her state ID, she could not see him. How much money does the state get to hold these kids? If put on probation I am to pay 15.00-20.00 per month from me to the probation department.

There is so much corruption, with so many people that ranges from Alvin, to Angleton, that I am not sure if anyone can correct this. I need help, my son is a minor, and he is being treated like an adult criminal, actually, he has less rights than a murderer.

    If it didnt have so many negative effects on people and there families,i would call Brazorria County Courts a joke.Prosecuters heard children through juvenile court like cattle.Over full court rooms collecting money by fees and fines imposed on the responsibility of parents.If you are truly innocent and want to be found so,..well i went 7 times before giving up and pleaing to a $300 fine plus court costs.
Prosecuters didnt want to see any evidence i had to prove my innocence.The more convictions the better the promotion.

Me and my daughter went to court 6 times before the  judge subpoena my ex to give her custody because,i wouldnt agree on 1 year probation for her when she didnt do anything wrong.If my ex had cared at that time in her life she would have attended previous court apperances.I have to add that my ex is a better person today and doing well . i have plenty stories of corruption and deception and wrong doings from this place, with evidence . Here is one small piece of deception-you can look up criminal records on people and it shows every little thing one at a time usually.in which lots of people have multiple pages listed.Now when you get a corrupt member (this time being a sherff's deputy that sold drugs and robbed people } they try to hide it.Ex deputy Robert Ullom has to many wrong doings to list, but look for yourself ,its all listed under 1 charge "no front license plate ". If thats not deception , I dont know what is.My apolgies to mister ullom for using him as an example .Hoping he is a better person today . Google -Brazoria county jail search by defendant

   We are all supposed to be equal and deserve a fair chance in life.there has to be a better way to fund our goverment

 I read your report,and have to say I have a 16 year old who has been through HELL and so have I,through Brazoria County Court. Since this is an old case I just found,you may not be going through the same scenario,however all of your frustration sounds so familar as I am dealing with a similar case now! I hope you got media help  with your case,because I know I need help with mine! Please read the posting I have posted under Kangaroo Court Corruption at the Hands of Judge Holder. I hope sincerly that your outcome was a good one!
