My name is Cindy I am disabled. I am trying to write this again so that it makes sence. I struggle with my brain damage. Sorry.
A broker was unethical and had me sign a mortgage i didn't understand only because the payments were going to be less while I recovered from an epileptic seizure. I explained I was incompetent. I was told that income lies needed to be put on the application just to push the paperwork through .
I was turned downfrom welfare 2 times so I asked that they not do that. I didn't want to lose my benefits. My Washington Mutual Mortgage payment was under$1200.00
The Truth in Lending showed
12 months of $880.60
12 months of $880.61
12 months of $946
And my 1st payment was about $1570.55 .
So when I 1st saw that $880.00 payment, all the broker an i discussed was how that would give me he 3 months to recover, find a job and begin to drive again.
I do not qualify for othe loans because of my loan to debt ratio. I do not qualify for government assistance. I hope that I conveyed my story better this time. thank you again.

It is unfortunate that you are suffering from seizures, but using that as a defense based on your report is inappropriate. Using the word rape in this context is even more inappropriate.
You say that you told the broker that you are incompetent...what? If you are competent enough to know you are incompetent why did you not have someone with you that could act on your behalf. Here is why.. Because you thought you could use this as a defense in the future if something didn't go your way. Proof of this is because you are writing this report and using that as an excuse..sounds like you are pretty competent.
The broker may have lied on your application, but you need to take some responsibility also. You admited you didn't want them to do it. But you signed the documents anyways. Disability or not you knew EXACTLY what was going on.
If you do feel that you are incompetent the best advise is to have someone you trust appointed your trustee who can handle all of your affairs. If you have no one to trust go to the court and have them appoint a trustee for you. You can't have it both ways in claiming you are incompetent yet wanting to handle your own affairs.

So he held a gun to your head and made you sign it? You signed a document, and admitted above that you KNEW he was putting fraudulent income on the application, yet YOU signed it. I bet you were all smiles when he got you approved weren't you. Now that the sham is exposed and you can't pay you blame the big bad mortgage broker.
The story is this:
You signed a fraudulent document for a house you couldn't afford. Period. You didn't understand it? Then why did you sign it? You knew it was fraudulent? Why didn't you walk away.
All you people who are expecting the govt to let you off the hook because of your own lack of control at living within your means and who got mortgages for houses you couldn't afford really get under the skin of those of us who live within our means and buy a house we can afford.
