I went online to bronxsuzuki.com looking to purchase a pre-owned car. I saw a 2003 landrover freelander advertising on their site for $13,995. I called them and set up an appointment with them and i also explained to them that my credit was poor, they assured me that will get me into a brand new car or even a preowned car. I went there the next day and we began the process. They told me because of my credit score I was only approved of $15,000 and they also told the bank that i deposit $1600 which i didn't, so they lied to the bank. Anyway, I saw the freelander and thought i'll get it because it's not over $15,000.
They started the paper works and then the time came for me to sign the contract..I looked it over and notice that the vehicle cost was $16,000. I spoke to the finance manager (Jimmy and doug) and asked him why was the car advertising for 13,995 and on the contract it's saying 16,000. He told me it was all bank fees...because of my credit situation i was desperate for a car so i believed him and signed the contract and got the car. when i got home, i called my good friend and told him everything and he told me to call the bank that i got the loan from and investigate because no bank should be charging 3,000 dollars in fee and further more they said the bank approved me for a 15,000 loan.
I called the next bank the next day and spoke to the bank manager he assured me that they don't charge 3,000 in bank fees..then i went back to bronx suzuki and the finance manager there said it's some back door deal i wasn't suppose to know, the bank is not going to tell me their business...immediately there i knew something was fishy...i asked to speak to the owner of bronx suzuki and he was no where around..for days i tired to contact the owner (nick) and he was never around or ever got in contact with me...
I went to bronx supreme court(small claims court) and filed a lawsuit against them...now the finance manager Jimmy) that i dealt with never showed up, the owner (nick) whom i was trying to get in contact with did..while in the court with the volunteer judge(which was a big mistake) he told us that the car was never advertising for 13995, even though i printed the flyer online and brought it with me to court..the volunteer judge, ruled in his favor because i signed the contract...
A month after having the car it started giving problems and they refused to fix it because my 30 days warranty was up..lol
I've learned 2 lessons here...never go to court and use those volunteer judges and always bring a man or a second eye with me when i'm purchasing another car.

I have been in the automotive field for quite a number of years and have been aware of the fees held by various Sub Prime Lenders. This consumer probably either financed through Drive Financial or CPS, both banks being primarily in the sub prime market and both banks withhold substantial fees in the event of default. The fees I have seen withheld have been as high as 4800. (rounding the number) The fees are based on the consumers past credit history...the higher the risk, the higher the fees. She should have contacted the bank she financed with, after all there is a truth in lending law. Instead she contacted various other financial institutions, which most likely cater to good credit risks. The courts usually lean toward the consumer, and the fact that she did not win leads one to believe that the dealer did not defraud this consumer.
