My car was repossessed in March. I paid the fees to get it back. I signed a new payment agreement. CJA finance agreed to take the payments on agreed dates. They fail to do so and I made a call to remind them to run the payments on my credit card. They missed another date and I wrote them a letter on June 20, 2011 reminded them they are not holding up to their agreement. They took two payments prior to the agreed date and attempted to take another payment 4 days later..They repossessed my car from the parking lot in another state while I was attending a track meet on July 29th. I offered to make the payments current and they said I was in default for not making the payments  when it was their responsibility to deduct it out of my account.

1. at the beginning  of second agreement, they did not take the payment out when scheduled. I called them to inquire why they didn't give me an answer they just asked can we take it out now. I said yes go ahead. they did. I did not take the money and use it for something else. The money was there for them to take.

2. They missed another date and I wrote them and reminded them they are not holding up to their part of their agreement, not because I took the money and spent it elsewhere.

3. another instance they took 2 payments out, the money was there and tried to take another payment a few days later.

You state that they didn't take out the payments on the agreed upon date so you sent them a letter stating that they are not holding up their end of the agreement when they missed a payment.  Yet in the very next sentence you say they are taking out the payments 4 days early?

Which is it are they missing payments or taking them out early?

If I was to guess I would say that when they missed taking out the payments instead of finding out why and paying them you decided to use that money for other items.  Then when they did try to submit the missing payments that money was no longer there so one ore more of them was rejected.  As such you became delinquent and they repossessed the car for a second(that we know of) time.
