Me and my boyfriend went down to Cactus Jacks to get a vechile. We were sold a Mitubitshi Endeavor 2004. We had a trade in and then had to also put down some cash. We had to defered payments that we to be paid on certian dates. We had no problem with the first one, but the second one we needed an extra 5 days. We called them and let them know. After them telling us that we needed to borrow money or take out a payday loan (and not explaining any of what would happen if we did not) we simply told them that we would pay that Friday, They had called on a Tuesday of the same week. On Thursday after I had picked my daughter up from school, they came and got the car out of my drive way with out me knowing. I had my purse and a lot of personal items in the vechile. I called and they stated that this was all explained to us when we purchased the car. NO it was not!!!! I said we have not signed any thing nor does any paperwork that I have state anywhere that you will come and get the car (in the paperwork it states that we will owe late fees). She then stated that "oh well we dont openly tell people that we are comeing to get the cars, they tend to hide the vechiles." They took the car for 300.00. In that conversation I asked her about the trade in vechile that we had given at time of signing paperwork. She stated that it was theirs now and that we could not get it back. She also let me know that if I wanted the rest of MY personal belongings (excluding purse) that I would have to pay 25 bucks to get it back. Is this really legal? Can they take our trade in when we hadnt even made the 1st car payment? I am now in the process of looking to get this taken care of. I resently received a letter from them stating that they are going to sell the vechile and that what ever it is sold for we may owe the remainding amount, WHAT? THE CONTRACT WAS NOT EVEN IN FULL EFFECT!!! Owe something. I think they owe me my trade in at least! A word to the wise stay far away from them. They are in to stealing. It is horrible what I have now heard about them. I wish I would have known these things before I had gone there!

I have purchased 9 vehicles from this company, and was formerly in the repo industry. They deal with people everyday that take the cars make the first payment and then disappear. Yes, they were within their rights to take your trade and repo your vehicle when you failed to make your pick up payment which is additional down payment you agreed to pay. When you did not make that payment as agreed of course they had the right to repo and the fact that you agreed to pay, they agreed to sell you their vehicle, and you failed to hold up your end of the bargain. It's rather simple. Is it morally ok? Maybe not. But think of it this way. If you didn't make your first payment which was a pick up payment, then why should they take the chance of you taking off with the vehicle??? If you loaned someone 7,000.00 and they were supposed to pay you $300.00 and didn't wouldn't you take back your 7k right away??? hmmmm As I said, I have purchased several vehicles, and sent several friends and family members to them. The only ones who have the issues and have to speak to rude people are only when they don't make their payments. I just paid off car number 9 and I spoke to them twice in two years! To buy the vehicle, and to see when my title was ready for me to pick up.
