We purchased a 1994 Ford Aerostar van from calcars over a year ago. This vehicle's axle broke as we were driving with our children in the vehicle--its a miracle we werent injured. We have called calcars many times to come and pick up the vehicle, as we cannot find parts for this van. We even tried junk yards to get a new axle to no avail. We were told they do not make the parts for it any longer. We want calcars to come get this piece of junk as it cannot be driven and we refuse to make payments on this vehicle as it is totally irrepairable. Even if it goes on my credit report negatively, so be it. This was the first and last car we got from there. Also, conveniently, the calcars around here in Cincinnati went out of business so we cannot contact them. Any suggestions?

well, good luck on filing a suit against them, calcars doesn't exist anymore, the company was sold to carbiz a couple months ago. may make it easier to get a duplicate title though.

A 1994 ford aerostar with a broken axle isn't worth the money it's gonna cost them to haul it away. Especially if calcars is no longer in your area. It was probably worth a couple of hundred dollars wholesale when you bought it last year and now it's even less. What does that tell you when they won't even come get it. I'd probably call a local junk yard and find out what their paying BY THE POUND for junk cars. It might be 25 or 50 cents a pound. You might get $100 or $150 if you're lucky.

Here's a suggestion. Send a certified letter to calcars demanding they come get the vehicle. IF you had sent the letter a year ago, you'd be in much better shape. In the letter explain that the vehicle was a dog and you attempted to come to an agreement with them but since the went out of business there was no one else to talk to blah, blah, blah. Have a written copy of all the times and dates you attempted to contact them. They're gonna screw your credit if it's isn't or hasn't been done already.

In the law, there is a section that says a company MUST limit it's losses. IF calcars had repo'd the car a year ago, when you requested it, their losses would have been much less. By not doing anything about your vehicle, they didn't attempt to limit their losses. IF you take them to small claims court, I don't know what the limit is in your state, there's an excellent chance you'll win. YOU'LL have a judgement aganist calcars in the amount of what you owe on the aerostar.

Here in TX, a business can be charged for TRIPLE damages. They might even owe you money. IF calcars is no longer in business in your area, you just might win by default IF no one from calcars shows up. I'm not an attorney but I've seen it done before. See if there's a local legal aide somewhere in your area who can help you with this. Don't sell the vehicle until you get it straight in court. You can always offer to give them their POS back If they actually show up. Good luck and let us know how it turns out.
