I purchased A Schult-Oakwood Manufactured Homes November 28, 2004

The unit arrived, May 26,2005
It had an electric furnace, not gas as was standard. The $772.00 stove I paid for was not installed. A much cheaper one was in its place.

After the setup crew left it was hard to believe how out of level it was. Slowly the setup went on, could not see why the wall cracks were fixed, doors hung without leveling the unit first.

The furnace air conditioner was installed with large openings around the filter mount, letting unfiltered air into the unit. 3 inch holes in the ceiling from running the wire for the celling fans, the electricians could not find the end of the wire. Trim was painted the wrong color.

As of November 15 2005, 24 weeks after delivery, California Homes Direct has not corrected any of these problems. The manufacture Clayton Homes has been contacted, they say they will assist in getting the house finished.

24 weeks for setup???? My heavens, you've got to be the most patient person that I know!

First, you are under NO obligation to accept the home in the condition that it's in. If you've obtained a mortgage with a construction loan attached, you may be able to have the bank intervene on your behalf. Most construction loans have an 'end' date that they expect to have work completed by, and they will call the company that you're working with.

Second, you need to become a PAI to the retailer. Since the setup is not yet complete, you need to hound them about getting things squared away and completed. If the home has not been set to the manufacturers instructions (provided in the home and given to you upon move in), make sure that you sign NOTHING until those instructions have been followed. This includes leveling your home with a water level method vs sight leveling.

Third, the BBB seems to do you no good, as this is a paid organization. Your time would be better spent going through your state HUD commission. Even then, you're looking at an extended time period to work things out. Instead, you might want to look into who actually owns the retailer that you're dealing with, and complain to them. You can usually figure out contacts with just one KNOWN contact. Send out 'blind' emails, one of them is bound to hit. Contact the factory higher ups using this method (examples might be kclayton@claytonhomes.com (net), ktclayton@claytonhomes.com (net). The person that you're looking for is the one that oversees the retailers. I sent mine to the CEO of the company, who in turn sent it down the line to the appropriate person. Total time it took to get action once I started this course was LESS THAN A WEEK!!)

Contact other dealers/retailers for average setup time. Document this, then call your retailer back.

If you're currently paying on this mortgage (ie: paying for a home that you're unable to live in), contact the lending institution, any media that is willing to listen, and the retailer. Let them know that you've filed a ripoffreport, tell them that you've contacted HADD, and any other action that you're taking to resolve this issue. The best way to get action is to get ATTENTION. You own the property that the home is sitting on? Put up a sign telling how long it's taking for setup, offer details as to the type of setup that you've received, offer details as to what was ordered vs what was received, provide documentation supporting your statements. Remember, for every person that walks away from this dealership (manufacturer), they lose money. Make sure they know what you're doing..... If they aren't aware, they can't take action. Money talks. :) In doing this, don't threaten them (blackmail) with something that you haven't done or don't intend on doing. Keep it straight up. Your intention is to draw attention to the situation and the persons causing it, protecting other consumers from the same situation that you find yourself in.

Given the extensive amount of time that you have invested in this, you might want to consider telling this retailer to come and get their home, and find another retailer more willing to help you. Although we live many miles apart, (I'm in MI) out here the average time to set a house for move in is 6 weeks. Ours was done in 16 days (our home was delivered to the property on Oct 7th, 2002, and we moved in Oct. 23). My sisters was delivered and set up for move in in three weeks. Our friend was in hers in 4 weeks. As you can see, we're not accustomed to waiting the length of time you have.

I'm not an attorney, in fact, I have no legal experience whatsoever. I'm just an average person who had to look out for her families interest, and I feel your pain. If you need someone to vent to, please feel free to contact me via email. HADD is good about providing you a support person in your area should you choose to pursue that course of action. The situation that you describe is one that plays itself out frequently. I've read over your report a couple of times, and cannot determine if you've moved into this home yet. This can make a difference in how you want to handle the situation.

I've been through a similar situation (concerning factory defects, not setup) recently, although the company that I purchased from did indeed come through and repair my home. See ripoff reports on Fortune Homes. There are things that you can do to get repairs on your home. In addition to this website, you may want to contact www.hadd.com which is homeowners against deficient dwellings. They were a great deal of help and support while I was trying to get my home repaired.

Please take the time to detail where you're at now, and how you got there, which may help others in helping you. Remember to document everything, including 1. Names of those working on your home w/dates and times, 2. Who you talked to and when, with a detail of the conversation, 3. Keep copies of all correspondance, including emails.

Please keep us updated. The only way to stop companies from taking advantage of others is to let others know how you were/are treated. Good Luck!
