I became unemployed and the choice had to be made, keep the mortage payment current or pay credit cards.  Well I paid the mortgage.  Tonight I found out that Capital One / Direct Merchants Bank charged off my account and turned it over to Cambece Debt Collections.  The collector informed me that I owed $2700 dollars and I had two choices and only two choices.  Pay the entire amount off right now or pay them $700 dollars up front and $350 dollars a month for the next 6 months.  The collectors would not listen to reason and came off with a Gestapo attitude and did not give a s*** about anything.  All they wanted was a fricking payment.  They are true a*******.

Don't scare people by saying they will automatically lose if Capital One sues them.

You make it see like all is lost.

I was sued by Capital One for 12,000.00 +

 

They could not prove their case in court !

They could not prove the debt even existed, didn't have proper documentation.

Judgement of entered for DEFENDANT , me !

It is amazing how you had no problem borrowing a couple thousand dollars, yet when you decide to no longer pay them, you try to claim it being a "RipOff" because the collection agency won't "work with you".  Oh and of course it is not your fault is it.  After all you lost your job and you had to make the tough choice of either paying the mortgage, buying food for your starving kids, or paying the credit card bill.  So answer this...where in your agreement did it say that you only had to pay your credit card if you could?  The answer is of course no where. 

This may be a shock to you but a Credit Card company is not a charity, and you made a legal agreement that in exchange for them allowing you to borrow money, you agree to pay it back according to their terms.  Since you failed to make your payments(again the reason does not matter) they did what they legally are required to do, charge the account off. 

Now, I will tell you a few other things that may also be a shock to you.  Collections Agencies exist to COLLECT bad debts for as much money and in as short of a time as possible.  No I am not defending them just telling you the facts of your situation.  As such I will tell you that you NEVER talk to a collection agency over the phone.  All of your letters to them needs to be in writing and by certified mail.  So if you truly want to "make good" on your account you need to send them in writing an offer of what you are willing to pay.  Such as an initial payment of $200 within 30 days of their written approal and then 5 payments of $500.  Request that they confirm the agreement with you in writing.  But DO NOT sign the letter only print your name.

If they accept this agreement be sure to follow through.  But remember they are not a charity.  So don't try to say something like you will pay them $10/month for 270 months. Because that will be rejected.  Collection agencies usually want debts paid in a 6-18 month period.  So adjust your numbers to hit this timeline. 

One final thing.  Like many credit cards Capital One is very aggressive in filing suit against bad debts.  So if they file a suit, you will loose.  Once you loose they then have the legal right(depending on your state) to Garnish your wages, and even attach your bank account.  And  unlike the initial Statute of Limitiations, again depending on your state they could attempt to collect this debt for anywhere from a few years to the rest of your life.

So no, this is not a RipOff and they are doing nothing more than YOU agreed to when you originally got the card.

 

Oh and no I am not now or have I ever worked for any credit card company, collection agency or financial institution.
