Received multiple calls from a local area code in a row and only 1 voicemail stating "I was part of a lawsuit and there would be criminal charges." (My brother, father, and mother also got the same calls and not sure why 2 of them did since they would have never had their number) I called the number they gave me in the voice mail (855-208-5402) back and the woman took my phone number, informed me I had an outstanding debt with an auto loan I had paid off 2 years ago. I tried explaining to her I had paid it off and she got very defensive and told me to fax the charge off notice with in 48 hours or I'll have criminal charges against myself and my mother who was also on the original loan. She kept rambling about the criminal charges and wouldn't give me the fax number and told me to stop interrupting her. I said "u said I need to fax the paper but haven't given me the fax number" she got very pissed because I had raised my voice at this point from frustration. She rattled the fax number off so fast I missed it and she said "u have 48 hrs to fax it to me. If I don't get it we'll see your a*s in criminal court!" (Yelling at me at this point) and then hung up. After composing myself I called back and got someone else named Debra. I asked for the physical address (so I can certify mail the paper for paper trail) and she said they do not have one and gave me the fax number instead.

Sounds like a scam to me

AUTHOR: FloridaNative - (USA)

POSTED: Saturday, April 29, 2017

Don't fax them anything. They sound like scammers to me. First, they can't tell you that criminal charges will be brought against you for a debt. And it is certainly suspicious that they would keep yelling about the criminal charges and state that they have no physical address. That is a typical scammer type response when caught with their hand in your cookie jar.

You have evidence that you paid the debt. If it were a real collections agency, they have rules to follow when collecting unpaid debts. They can't collect twice on the same debt and they can't continue to contact you for a paid debt.

Don't call them. Don't fax them. Don't pay them. Report them to the CFPB. If they are real collectors, you can put a stop to the collections. If they are scammers there isn't much you can do except report them to the FTC and follow their instructions. Good luck.
