Visited this place in July 2014 to check out a vehicle.  Came to an agreement on the total price of the car, which is only available if I enter in the "Special Financing" program that they offered.  We agreed on a price of $26,500.  I put a $7,000 down payment on the car, therefore the balance was $19,500.  We agreed that the $19,500 would be paid out the next 3 years = $6,500 per year or $550 per month for 36 months to pay off.  After this the car would be paid off and title would be mine.

 

Here's the logistic behind their special financing.  The agreed upon price of $26,500 would only be available to me if I chose to finance.  So under the "contract" I signed, if I pay the required amount every month on time ($550), and if  my credit score remains the same at the end of 2 years, only then I would be able to keep that $26,500 price.  BUT if I miss a payment, they are subject to void the contract and I would be stuck paying a higher amount for the vehincle (which was $34k when I first received my first bill from the bank).  Isn't that insane?  I didnt know this was the case until I signed all the paperwork!! WTF!!  So I thought, ok, I have really good credit and I can defintely make the monthly payments. When I first received the bill, I called Car Approval Corp and asked why the hell does the loan balance say $34k!?  So they replied it's special financing, if I pay on time for 2 years, I have to return to the dealer and they will pay off that loan balance with the bank.  And I will only have to pay the "supposedly" $6,500 leftover balance.  So I was sort of relieved

 

So fast forward 2 years later, I was under the impression that since I've been paying $550 for 24 months on time, now I can return to the dealer and ask them to pay off the current loan that the bank has me under.  Come to find out, I cannot find the dealer at all.  They are out of business!?!?!?!? WTF! Instead of having a $6,500 balance I now am stuck with a $24k balance with the bank.  I'm reading other reports on this company and how they scammed others the same way.  I was screwed and am looking for a lawyer.  Will reach out to others who were scammed by these goons (manager name was Joe) and taking legal action so we can locate these guys and get justice!  By the way the $7k "down payment" went into their pocket!  I am so mad at myself.

Sounds like you believed the sales rep

Just for your information, a verbal change (or explanation) can not override a written contract. Written contracts have to be amended in writing only. If you read your contract, there is usually a paragraph that says that consumers should not rely on any verbal representations and that the entire agreement is what you are signing.

The sales rep or finance person was clearly taking advantage of your inexperience with loans.  When you sign a contract and it says that you are agreeing to repay $34k+, then that is the deal.  You can pay off early with a lower interest rate if you qualify for a new loan.  No dealership or bank can prevent you from refinancing - unless you don't qualify for the new loan. You usually have to go to another lender to refi and not the existing lender. 

Research loans so you know what to look for when you purchase anything that needs to be financed in the future. The loan amount will be in writing on the contract. There will also be a disclosure for interest rate and APR. NEVER believe a verbal change to the contract.  If the sales rep or F&I person says that you would only be responsible for $X, then that is what needs to be in writing on the contract that you sign. If the amount is different - either have them change it before signing or get up and walk out without signing the contract. Don't be surprised if the F&I guy refuses to change it. That means the scam was intentional from the beginning and then you should run out of there as fast as possible.  

This type of scam (misrepresentation of the amount of purchase price or amount financed or both) is very, very common in the auto loan industry. You can file a claim at CFPB, but I'm not sure they can do anything about it if you don't have some written proof of your side.  If you do have written proof, take it to an attorney and file a lawsuit, but it is difficult to recover if they are out of business now. Next time don't sign anything without reading and understanding what it says. Don't believe a verbal modification to a written contract. And lastly, bring in your own outside financing when buying a vehicle. It will be much better for you in both the short and long run. Good Luck.

In your original report you indicated and left every impression that you no longer had 5 years of files.  Your exact words were

"I am looking for a suit for upwards of $5 million for the loss of 5 years of propritary art, photo's and video trailes...."

Those were YOUR words..you specfically used the word "LOSS".

Now, in your update you try to come off saying that you did have backups.. Again your exact words were "I have years of files. The particular files I was using at the time are from about 2010-2011.  Files I had uploaded from DVD's."

Again those were YOUR words.  So in the matter of hours you went from having all of your data lost, to having a full set of backups.  Which is very funny in another way because in your original post you also tried to come off as some naive user who hasn't a clue about computers.

Well guess what, the only time you would have lost is the amount of time it takes to restore those files to a new laptop.   Which I can guarantee you is not months, not even days, but at most hours.  So the fact that you went back and forth with them for a few months over a few hundred dollars when you are now claiming you had the backups. Not to mention the fact that the original reason you went in there was to get a new laptop, and apparently even though you have spent millions of dollars you didn't want to buy another laptop for a few hundred dollars to keep going? 

THis proves one thing.  That one of your stories is an outright LIE.    

Now, which part of your report is a lie is something only you know.

Oh and as I said before about respect.  Your update just blew any respect I had for you...true military veterans who actually care about this Country DO NOT LIE.  If you want respect...you must earn it.
