Bought a car 1/19/16, one month in our engine blew and is rendered useless. VERY MEAN AND NASTY EVEN CURSED AT US OVER the phone. Threaten us with locking our house doors, levy our bank account, garnish our wages, take us to magistrate, and 1099 us? wwe are late 8 days. dont have the extra money to pay 134 a week and a rental. i told them that and the reply was o you have money for a rental but no money to tow up to us and pay your weekly payment. Yes I do , I have 4 kids that have to school and I have work, cant be without a car. asked if i could wait a few weeks they said no, that they are expected to pay their bills on time so should I? REALLY?!!!!!!! My car is also on the recall national database list and in 63 accidents none of that information was disclosed when i purchased.. THEIVES SCAM ARTISTS! Should be shut down for fraud and unfair debt collection process.

8500 for a car with a blue book value of 2800 new! Havent drove it since it broke down. They still want me to pay  145 weekly payment and 100 to tow it up to them?!?!?!?!!?!!!!!

They Come buy my house pounding on my door and creeping around my house outside perring in widowns. IM 8 days LATE!!!

Need to make a correction...

AUTHOR: Robert - (USA)

POSTED: Sunday, April 10, 2016

You stated the following...

"I have no problem paying them".

That is not exactly correct as there is another part to that statement you left off.  What you really mean is the following.

"I have no problem paying them....as long as they let me change the original agreement I signed and pay what I want when I want".

Brings a whole new meaning doesn't it.  But this is EXACTLY what you are doing as stated in your own words.  As if you really had no problem paying them you wouldn't be 8 days late and you wouldn't be posting on this site.

So unless they have violated something in the written loan agreement then you can complain and give your excuses how they should make an exception for you because of  your "special circumstances".  But it won't change the fact that the only one who appears to be violating the agreement is you.

By the way...just about everyone has some "special circumstance", after all life was never guaranteed to be easy.

I live paycheck to paycheck and just dont have the extra money to have a loaner and pay for the car thats broken I have asked if we can get a lower payment until we can get it fixed they refused. my son has a brain tumor and we need a car to get back and forth to danville for his treatments. It was them around my house the guy left a business card in my door.

A few things...

AUTHOR: Robert - (USA)

First of all you pretty much lost me at "63 accidents".  Really so this car has been in 63 separate accidents..seems like there is something a bit off in the reporting here.

As for the recalls, there is generally no law that states they must disclose any recalls.  However, they also can not sell a car that is not in a "safe" condition.  So if there were open recalls that would make the vehicle unsafe they should take care of these.  Now, does this mean you get a "get out of jail" card and are able to just walk away...not exactly.  In general you would have to give them the opportuntity to "make it right" and if they don't then you MAY be able to take further action.

However, in this case you would probably have to prove that one of these recall items was a direct cause of the engine going bad.  So you probably should consult a lawyer if you want to go down this road to see if you have any claim.

As for the payment.  Yes, they are going to expect payment as you made a legal agreement to do.  Where unless there was something in that agreement you only needed to make a payment if you could drive the car..you still owe it.  And as much as you don't like it, yes even though you don't think it is fair it is a valid argument on their part that if you can get a rental..you can pay them.

If they are doing what you are saying around your house...call the police and file a report.  Perhaps it isn't them, perhaps it is an actual criminal.  But just to give you the flip side again.  If you are delinquent..even 8 days they do have the right to reposess the car.
