"Good Living Pools" "Evin Acri" Decieitfully sells totally unusable broken used pool equipment under false assurances and paperwork with fake 1 year warranty. Complete thievery. Sun City California

First of all everything stated here will be to the basic point but is not exactly how it will be presented to the courts in regards to "Misrepresentation of Material Facts" and is backed by every involved witness testimony , every involved witness' cell phone text communication with "Evin Acri" of "Good living Pools" P.O. Box 4100 Carlsbad Ca 92018 and my signed reciept document from Evin. My pool contractor reccomended Evin to me as an associate of his that would save me money by selling me quality used pool equipment as opposed to brand new equipment. The price of $4000.00 dollars for all equipment needed to get my pool up and running correctly to code regulation with a 1 year warranty for replacement was decided upon through discussions with Evin. Evin had me meet him in a storage facility that he stores his used equipment for sale at. I purchased the equipment for $4000.00 which Evin hand wrote me a reciept for with his writing giving 1year warranty on equipment sold to me , signed it ect. When the equipment installers recieved the equipment they made mention that the equipment resembled stolen equipment because it was chopped at the wires instead of disconnected, and missing normal things that one would keep when they removed used equipment from willing people in order to re-sale it. I called Evin with their concerns with being involved in possibly installing stolen equipment should something come up through the county inspection process and even put the installers on the phone with Evin in order to hear directly from Evin the assurances that this equipment was legit and he also assured them that everything was in working condition. Under the circumstances of pool construction we must rely on the statements and promises of Evin to be true in quality because equipment is neccesary for inspection purposes even before pool will function or have water in it to test equipment. Approximately two weeks ago the time to add water to the pool comes and all equipment must now function but the pump does not pump, the control panel is not functionable, heater does not turn on. Evin is called immediately because if water does not circulate permanent damage can be caused to the pool. He claims everything was perfect and it must be installers problems. Installers and I ask him to come show us how to get this equipment to work. He makes times to show up but he does not show. Next he changes his mind that it must be the equipment and he asks for the installers to take equipment home with them because they live in his vicinity and he is not available to come to location of pool because of his busy schedule so he can just swap out non functioning equipment for functioning equipment. All the while the installers and I are expressing to him the dire need for the equipment to start running asap. The installers take the equipment home with them and immediately begin calling Evin because he requested for them to bring it to him , then he doesnt have time that day, then more unavailabilities ensue. Finally he agree's to a time and day ,and actually shows up to swap the equipment out with the installers at their home but forgets "he says" to bring equipment but will takes the equipment from the installers and promises without fault in the morning the replacement equipment will be delivered to them. Next morning only a text message saying "nope" from Evin is sent in response to the installers message asking if he is still going to show up that morning. Then a phone call between installers and Evin takes place in which Evin tells them that he has no idea who they are and he has no business with them. Then myself and Evin speak in which he claims he is being harrased and threatend by installers, myself , the contractor and he will sue everyone for harassment. The only issue clashing to the contrary of this claim of harassment or threats is that nobody involved ever had a bad word or even raised their voice prior with Evin. Text message records show regular sane communication , besides him not responding, excuse making and outright avoiding calls everybody involved felt anger would only make this situation worse not better. He was called by the people he requested call him. He was contacted in regards to issues he wanted to be contacted about. I recorded the last conversation I had with Evin just for purposes of any attorney interested in refuting claims of anger or threats being made towards Evin. I understood very clear by that time that that was where we were headed. Calling Evin to honor his word or warranty is a threat or harassment to Evin, accomodating his requests of appointments or communiction times is a threat or harassment to Evin. Evin just likes to sell people broken equipment for lots of money! Guy is sociopathic about it. You will hear him say everything correct ,right before everything goes completely wrong. Then will turn hisself into a victim. A victim that steals $4000.00 bold face.

My damages are now much more than original $4000.00 , and all witnesses to this are willing to testimony. All parties involved are blown away by this situation. Any Attorney specializing in this matter is a welcome to contact me.
