We refinanced our home with Chase Mortgage Credit Group because the owner, Areyo Dadar called and promised he could beat our current rate of 5.5% fixed for 30 years. He told us he could offer a 4.75% fixed for 30 years, no points, no pre-payment, and a no cost loan.

He sent his associate Paul Bakhtiar (he said his name was Paul Baxter) to explain all the details. Everything sounded good at that point so we signed the documents a few weeks later.

Paul Bakhtiar came late with Pooyan Bakhtiar (the notary) in the same car with the final documents. We finally signed everything then asked for our copies. They told us their copy machine wasn't working so they would send it to us right away. We called all of them numerous times to request copies of the signed documents yet all we received were empty promises. Upon receiving our first statement a couple of months later, we realized the loan was changed to a 7.75% adjustable, pick-a-pay. $20,000 was also added without our knowledge.

We notified Areyo Dadar and Paul Bakhtiar many times about this matter and they said it would be corrected right away. After 3 months of empty promises we reported them to all the various agencies that deal with matters such as these. We have learned that they had many cases similiar to ours and even found a federal case against them online.

Their numbers have changed over 4 times in the past few months and now work out of San Diego not Encino. Please beware of frauds like this out there!...they will lead you on and promise everything will be fixed but they won't...in fact, they might even try to put you into another loan so they can rip you off even more!

Latest Information About AD and his scam

AD was sued in Federal Court and he lost.  We are also victims of this scam so we found out the name of the attorney who filed a case against him and contacted that law firm.  This is the information we found:

The case is now over - AD lost in court and the victim was awarded compensation (the lawyer did not say how much).  Unfortunately, and to no one's surprise, AD disappeared so the victim was not able to collect on his judgement against AD. 

As a result, the victim threatened to sue the bank that holds the loan unless the loan was modified.  In order to avoid a lawsuit that was already won in court, the bank agreed to lower the terms (again, the lawyer would not give details).   Unfortunately, the lawyer stated that the amount the victim saved from the bank loan modification equaled to how much he spent on the lawsuit so he ended up with a net of zero savings.  Very unfortunate.

I understand why the victim went forward with his case - it's a matter of principle.  I am encouraged to see AD posted on this forum so he's probably still in this country, which means eventually the victim will collect on his judgement.  It's going to follow you forever AD!

Since Areyo Dadar and his crew lied and scammed so many people, we did some research on his story. We found out that not one of the places mentioned knew anything about this.  Also, there are just too many people involved and it has been going on for way too long for this story to have any truth to it. All of our lives ruined because of your little scam and now you people feel guilty or bad??? Sorry AD and crew you guys will have to think of a better excuse than that! It's just a matter of time before you guys will be locked up for a long time!!!!!!!!

My name is Areyo Dadar.  I was the owner and broker of record for La Jolla Lending & Real Estate.  I just recently became aware of this incorrect post about me.  I want to set the record straight of what happened.  I had a business partner that impersonated me and conducted fraudulent activity without my knowledge.  By the time I was notified of what happened, several loans had already been closed.  He took all the commissions made on those fraudulent loans and also stole a substantial amount of money that was mine and fled the country.  He left me with all the complaints, lawsuits, and fires to put out.  I was approached by the DRE (department of real estate) and district attorney's office regarding all that had gone on.  Once everything had been explained and proven they put a warrant out for my ex-partner's arrest.  If he decides to come back to the United States, he will be serving a long jail term.  I dissolved the company, I have been left with nothing, and have had to start my life all over again.  You can go to the California Department of Real Estate website www.dre.ca.gov and look my license (01745460) up and see that it is in good standing.  Everything has been cleared up. Real estate is my passion and I am in no way a dishonest person.  I truly feel sorry for any of the clients that had been taken advantage of by this manipulative and dishonest person.  I have been affected just as bad.  I hope people like him that take advantage of people get put in jail for a long long time.

In response to Jp, we did read the main pages at signing carefully and everything was correct at that point. After that (since they didn't leave copies), obviously the docs were altered before it was given to the lender (Wachovia).

It's strange how we didn't receive any of those major forms from Wachovia. I do remember a few minor letters of which AD and Paul said it was just normal for lenders to send forms like those during this period and to just "ignore" them because they didn't apply to our loan.

We do remember finally calling Wachovia to find out if they were the lenders for our loan and the representative said yes they were but she didn't have much information about it at that time and to talk to the rep in charge of our loan. She put me to his voicemail on which I asked him to call us back concerning details on our loan. A few hours later, AD called us back and told us why we were calling them instead of him. He said he was the only person who knew all the details of our loan and not to call them since they didn't know. I wonder how he got the message I left for that representative....strange!!!!! probably another person involved in their scam???

Oh and by the way Jp, what do you think would happen if someone tried to cancel their loan within the 3 day period beacuse things sounded fishy or too good to be true? exactly.....they will keep stalling or won't return their calls in time to cancel!!!! (I read and heard about some of these kinds of cases against them also)

It's not so simple

Shame on the person who blamed this poster! These people are scam artists! They tell you lies and because you are trusting, they take advantage of you. You just never think it will happen to you but it can. To place blame on this this poster who is doing a service by trying to warn others is just unnecessary.

Firstly, they don't leave copies of anything. You have no record of the loan. Secondly, the notary (Pooyan Bakhtiar) doesn't explain anything. He just asks you many personal questions to try to get you involved in conversation to distract you. Secondly, of course you notice the high rate. They just explain that the high rate will be "bridged" to the interest rate that was agreed upon. Since we are not all finance/loan/mortgage experts (hence the need for the Truth in Lending claus), you believe their perfectly crafted explanations. When the loan doesn't turn out to be at the lower rate, they make a million excuses, and you are left with a bad loan.

They have played this scam with many people and i've just added my name to the FEDERAL lawsuit that was filed in May 2008. I also reported them to the Los Angeles District Attorney's office for fraud. They deserve everything they will get from their scam.

Sorry to hear of your woes, it sounds like you may be stuck in a horrible mortgage.
However, it appears you are part of the problem with the current mortgage woes this country is having. Didnt you read your documents before you signed them??? The mortgage lender is also required to give you copies at the closing, plus there is a 3 day right to cancel. If they didnt do this, then you may have recourse. If you signed the right to cancel, then you are probably out of luck.
I am familiar with mortgage docs, and there is no way you could not notice the NOTE, MORTGAGE, RECISSION PAPERS and Truth in Lending that show your RATE, PAYBACK, etc. Shame on you for not asking questions or reading your documents before you signed them.

Scam In A Nutshell

Here is their scam in a nutshell:



1)The owner Areyo Dadar(AD) calls our home promising a 4.75% fixed rate for 30 years. He tells us that this is a no cost loan and that there is a no pre-payment penalty and no points except third party costs which will total about $1,000. He tells us this low rate is only possible for people with excellent credit (info he said he got from Countrywide Home Loans) and that this is from the wholesale dept so he can offer these prices and rates.



2) AD sends one of his associates Paul Bahktiar (aka Paul Baxter) to our home to confirm everything he told us on the phone and give us a good faith estimate. He tells us his name is Paul Baxter from Chase Mortgage Credit Group and doesn't have any business cards at the moment but will bring them next time.



3) Since Chase is a large company and everything they promised sounded great, we accept the refinance. About a week later, Paul and the notary, Pooyan Bahktiar (Mike Bahktiar) arrive late at night in the same car. After we sign all the documents, we ask for the copies and they say copies couldn't be made because of problems with their machine, but will be mailed to us in the next few days. They remind us that since it is so late it would be very difficult to get us copies that night. We ask for their business cards and once again they say they don't have any on them, but will send them along with the copies. They give us their cell numbers and work number (all of which go to voicemail only).



4)Paul brings a few signature pages a couple days later telling us these were accidently left out, but were already explained by the notary and needed it right away for the loan go through. He assures us the copies will be sent out right away now that everything is complete.



5) No copies are ever sent. Numerous phone calls (many times they tell us they will find out what's going on and they would call us back the next day and/or they would never return our calls) are made to all three of them, but excuses are constantly made and later they each tell us that it is the other person's responsibility and they have no idea what's going on and why we haven't received our copies yet.



6)Months pass, then we finally receive a bill from Wachovia telling us that we are in an a Pick a Pay with our interest rate now being a 7.75% adjustable rate. We also notice that $20,000 was added to our loan.



7) We call AD and Paul and they both assure us that the problem will be corrected immediately and they don't know how something like this could have happened.



8) Months and numerous calls later, we realize that we were victims of a scam and the loan was not going to be corrected.



*They want to prolong everything as long as possible so victims will forget details of what and when things happened. They promise a lower rate, but take out all the taxes and insurance in your payment to make that possible. This means your payment is actually higher! In addition to the places I suggested to report them to in the previous article, you should also report them to the San Diego FBI, FTC, and there is a site called fraud.org. Please report these kinds of people everywhere you can so the can be stopped once and for all. If enough people report them they will eventually get caught!

New information against Chase Mortgage Credit Group

We recently did a yahoo search on Chase Mortgage Credit Group which used to be out of Encino and found out that their web page no longer exists. We found that their name has been changed to La Jolla Lending and Real Estate out of San Diego. Both of their addresses are the same, the phone numbers change often so we don't know if those are still correct.



It really doesn't matter though because all their phone numbers all go directly to their voicemail. The owner screens all the calls and they probably don't even have a direct line to the office for customers to call in case there is a problem or you had questions.



We also found out that the escrow company who is involved in most or all their loans was West Amercian Escrow out of Encino. They both worked out of the same building before Chase Group moved to San Diego. When we asked if the knew each other they both denied it, even though we see all of them involved in other cases as well (you can find a federal court against all of them online). Please report these people to the Dept. of Real Estate, Attorney General, BBB, local police, Dept of Corporation and real estate attorney right away so they can be stopped once and for all!



In addition, if you have been ripped off by them also, file a report here also. Then we can all file a class action law suit against these scam artists.
