Jimmy Lee at CheckCare called my mother today and disclosed the name of his business as well as the fact that he was calling because I had bad checks. According to the Fair Debt Collection Act, a collector is not allowed to state the name of their business or the reason for their call to a third party.
In addition, he called her numerous times, which is also a violation of the Fair Debt Collection Act. When she called me to tell me he had called and what he had said, I called him and told him not to contact her again, nor any of my family members. I told him he was in violation of the Fair Debt Collection Act. He proceeded to call me a thief, accuse me of stealing, and threaten arrest, which constitue harassing behavior according to the Fair Debt Collection Act.
He continued to call me after I asked him not to contact me again, which constitues harassment. He stated I was a terrible example to my 12 year old child - he should not know that type of personal information nor demean me in that way during a collections call. In addition, he never stated that the purpose of his call was in attempt to collect a debt (another requirement of the Fair Debt Collection Act).
Further, he never provided proof of the debt he says I owe, not did he provide me with the 30 days required by law for me to dispute or concur with the debt. In short, he is guilty of multiple violations of the Fair Debt Collection Act.
I faxed and sent him a letter detailing each violation, demanded that he not contact me or my family members again, and notifying him that I have filed the two complaints. The consumer agency responsible for assessing collection agencies needs to do an exmaination on this company and shut their doors.
Unbelievable treatment and violation of Federal law...

On 10/22/13, I received two voicemails from Jimmy Lee, stating the following, and I quote: we have a warrant for your arrest; we know you live in another state now and we will have you extradited for your felony; we will locate your husband and son; we know where you new residence is; what kind of person are you; we're hurting your son, your husband, your ex-husband, and your family to do whatever it takes to get you to pay; there will be warrants in the next 10 days; you have committed multiple felonies; we will get your little blond self; whatkind of life are you living; you have no shame; you are off the charts; you have stolen; wht a quality individual you are; we have an all out bulletin for you; you have created several felonies; you've committed a criminal act; these checks will be prosecuted; stop stealing; you have a son who is going to do the same things; we are going to get this to the courthouse. These threats of arrest, threats of harming my family, and attempts to intimidate and strongarm me are in violation of the Fair Debt Collection Act as well as OCGA Code. They are attempting to collect on checks more than two years old, which exceed the Statute of Limitations; did not provide the name of the financial instutition the checks were drawn from, the check amounts, the fees being charged; they never sent 10-day notices; the letter they just sent me does not follow the exact wording in the Georgia code that they are supposed to use; they threaten arrest in the letter. I have filed formal complaints with the Better Business Bureau, the Consumer Financial Collections Bureau, the Georgia Industrial Loan Commissioner, and I plan to retain an attorney. CheckCare needs its business license revoked and Jimmy Lee needs to be prosecuted for making threats against my family and harassing me. I have sent them several certified letters now demanding that cease communications and notifying them that I dispute the debt.
