Hello,
My Boyfriend purchased a home in Fairlawn Ohio. It was an estate sale so it was sold as is. We understand that, but, after liking the house with all of it's faults and having it inspected. The Realtor called and stated that the lock box was gone, and so was the only existing key. She also stated the door was wide open, but after Her inspection, all was well, and She would drive by the property and check on it from time to time until He took possession. He took possession a few weeks later on a Friday,
We both went there after the work day to begin measurements etc... I kept looking for the washer hook up because I had seen them before and I wanted to measure the space. It was then that He noticed the pipes were all cut out. A Police report was filed that night, the Realtor was contacted the following day. There side said since the house was sold as is, they are not responsible. The point is, the house was accepted with all of the plumbing intact(as is). The security was breached on their watch. My Boyfriends insurance should not be held liable.

If you can prove that the pipes were there before closing

If you can prove that the pipes were there before you closed on the home, then you have a case. However, that could be harder to prove than you think. The insurance company for the seller will require concrete proof that before the closing date, the pipes were present.
Did you have the house inspected? If yes, then the inspector could have verified that the pipes were present, and there would be a date on that report.
Even if you did have that report, and the inspection was done 30 or 60 days prior to closing, the insurance company would come back and say that there is no proof that the pipes were not stolen from the home after you took possession.
In other words, the burden of proof is on you to prove when the pipes were stolen. If you took them to court, you would have to show when the pipes were stolen.
I think you are fighting a losing battle, but you can try. Just let your boy friend's insurance company pay.

The pipes were there before closing. the home was entered before closing and the front door left open. after closing when we went in, he noticed pipes were gone.

If your boyfriend closed before the house was closed on, it seems you may have a point, however, your Boyfriend will have to have proof that the pipes were actually there when he agreed to buy the house. If on the other hand your boyfriend closed on the house, and the pipes were stolen then, it is his responsibility
