on June 5, 2008 I sent payment for a tempurpedic classic queen mattress via paypal. i found the mattress on craigslist austin. the seller's name is
Christopher Doherty. He has been responsive since the payment (phone and email) but i cannot get a UPS confirmation number from him to confirm shipment. So, now i'm nervous that i'm in the process of being a victim of a bait and switch. I did a google search for him and was not happy to find him in this registry (Ripoff Report) for exactly the same deal (same price, same mattress, same description, etc) as what i found on Craigslist Austin. Now of course i'm scared that i'm in the proess of being scammed. I have not received a mattress from him yet (real tempurdedic or otherwise). I'll i want to do now is cancel the deal and get my money back.

Do i have any course of action?

Course of Action for Christopher Doherty's Tempurpedic Scam Once Payment Has Been Sent

This is my suggestion and wish that I had done the same.
I would notify Christopher Doherty that you have yet to receive the mattress and that you want to cancel your order ( make sure he gives you a cancellation number) and desire a full refund to your paypal account. If he tells you that he has already shipped the mattress, tell him that you are aware he is able to reverse the shipment through his UPS account.

Once you have done this, if he does not refund your money, you should be able to get all your money back through paypal. From what I read it may take some work on your part i.e., filing a dispute and then a claim through paypal, but again, you should be able to get all your money.

Below are a few excerpts pulled from the paypal agreement posted online that might be relevant to your situation. Just in case you might want to read through it yourself to make sure all your bases are covered.

13. Disputes between Buyers and Sellers -
13.1 Buyer Protection Programs.
If you buy an item using PayPal and either DO NOT RECEIVE the ITEM or receive an item that you believe is Significantly Not as Described by the seller, we encourage you to open a Dispute with the seller in our Resolution Center. By doing so, you will initiate our Online Dispute Resolution Process

PayPal Buyer Complaint Policy
a note for clarification on Paypal's buyer protection programs: paypal has two types: (1) the Buyer Complaint Policy and (2) the Buyer Protection Program. The Buyer Protection Program is for those purchasing products on ebay OR purchases payed with your debit card and payed through the ATM network, hence your card payment type on your paypal "history log" will not read as "credit card" but as "ATM/debit". This Protection Program is more comprehensive and if it is applicable it should be easier to get your money back, because Paypal is covering your purchase.

13.3 Filing Deadlines. We will not grant any Claim unless you first initiate a Dispute in our Resolution Center within 45 Days of the date of the relevant payment and then escalate the Dispute into a Claim within 20 Days of the date you file your Dispute. It is your responsibility to keep track of the deadlines under this section.
-If the buyer claims that the item was not received, the seller must be able to prove that the item was delivered to the address listed on the Transaction Details page by providing PayPal with a Viewable Online Proof of Delivery For transactions equal to $250.00 USD (or the equivalent in the currency of the transaction) or more in value, the seller will also need to provide a Viewable Online Signature Confirmation.

if in the meantime you do receive the package at your house. DO NOT ACCEPT IT.
