On 11/15/2011 I opened account with City National Bank and Trust based out of Lawton Ok. The paperwork stated that it would take 2-3 business days to process the request. I deposited the initial request of 5.00.

On 11/16/2011 I called to see how long it would take for my online access to be made available and was told I needed to deposit money. I informed I already had and come to find out the branch manager that opened my account and "forgot" to deposit my 5.00. No need to panic it got corrected was informed if anything else was needed let them know and it would be taken care of. During this time I set up direct deposit with my employer.

Things were fine I was using the account got my debit card, got my checks in the mail, made deposits of 200 in cash and had access to those funds. My direct deposit was scheduled to be deposited on 11/25/2011.

11/25/2011 morning comes around I call the bank at 7:30 am and all my money is there. On my way to work I have to stop and get my daughter some medicine, at 8:23 I used the card and tried to get money out all to find out my account was at a 0.00 balance. So I call the bank and was told my account could not be found, my social wasn't pulling up, and the account number was not a valid account number......So I contact the branch that opened the account and am told that there is a hold on my account and then I get transferred to the fraud department. I spoke with a fraud specialist by the name of Tammy, who told me there was an account in 2005 that has similar documentation to what I provided and that account had an outstanding balance of 606.27 which they took from my payroll and the remaining part of my check was being sent to me via cashiers check to the address on the 2005 account. I proceeded to inform the bank I have never had an account with that bank and that the address on the 2005 account was not nor never had been mine. The fraud lady finally was able to stop the cashier check and I went and picked up the cash that was remaining from the bank (323.00). At this point I was told they would put a note for collections for them not to take the money.

The weekend passes and I start the process of filing an identity theft report, also a compliant with the FDIC which I have to go through the OOC. On Thursday 12/01/2011 this is the email reponse I receive after hearing nothing from the bank, I had left several voicemail messages, to no avail the email response is as follows:

We have reviewed the documents on file and are of the opinion that the documents provided most recently are the same as those used to open the original account.  If you feel that you have documentation which contradicts our findings, please forward copies to me for further review.  My mailing address is found below

No at no point has anyone contacted me or done an investigation of any kind, this response was sent to me from the Assistant VP and security officer (or so the title on the email says). And I was told the social security number from the account in 2005 and the one I opened now were different.

I am livid and going to be seeking legal counsil. No one can give me information about this account and tells me that due to confidentiallity they can not discuss the 2005 account with me becuse the infomation I provide does not match up. I need some help here, I am about to lose my house, I can't pay my day care and I have had my phone turned off because they stole my money.

It is amazing to me that it took 2 weeks on the day of my direct deposit for this mystery accout to be discoved. Why was it not done at the time when they did the verification of the account with in first 2-3 days when I was able to use the account.

Do NOT ever use this bank if someone makes a mistake or they have a past due account someone is going to pay for that even if they can't prove it is you and if you have never had an account. They do not want a copy of the police report (yes I was told this). Any suggestions or ideas as the best and fastest way to resolve. I have done everything I know to do.
