Classic Cabinet Fronts LLC John Vivio Contractor took $3500 but did no work St. Charles, Missouri

Until May of 2010, Mr. Jon Vivio had done business as Classic Cabinet Fronts LLC, Saint Charles, Missouri. He let his LLC expire and since that time works as an individual proprietor. He accepted $3,500 in cash in November, 2010, but never ordered the kitchen cabinets needed for our renovation project. He promised that the renovation of the kitchen would be completed before late December 2010. After receiving the cash deposit it became increasingly difficult to contact Mr. Vivio. Eventually, I decided to cancel our agreement in mid-December 2010, and sought return of the $3,500 cash deposit he had accepted. The money was never returned, and after receiving nothing but vague promises from Mr. Vivio about the money my husband and I decided to proceed with legal action against him. No work was ever performed by Mr. Vivio who decided to keep the $3,500 deposit. I am now seeking to collect monies awarded under a Default Judgment granted by the St. Charles Missouri County Court on September 20, 2011, from Mr. Vivio. Mr. Vivio now owes approximately $4,600 which includes not only the original $3,500 deposit, but also compensatory damages, attorney's fees, court costs, and interest on the Default Judgment. Mr. Vivio currently has 11 complaints against him filed with the Better Business Bureau and had received a grade of 'F' from that organization. He also has numerous other legal judgments totaling thousands of dollars, as well as several liens against his home.  Our efforts to collect the amount now owed under the Default Judgment continue as we incur added expense to do so.
