I odered a garmin nuvi 265wt. Next day I recieved an e-mail that told me for security purposes I needed to call. When I called they told me that they saw I didn't purchase current map software and that would be another $89.00. I reluctantly purchased it and also upgraded the shipping to 3 days. Even still the unit was about the same price as other dealers. After the call I checked with Garmin and found out that they upgrade all new units software for free. When I called back and told them I wanted to cancel the software because I was lied to they told me it was a wholesale unit and garmin would not upgrade it and that it had already been prepared for shipping with the new software and i couldn't cancel anyway. This was Sunday and i asked if their shipping department was open and they said yes. Then this occurred:

Thank you for your recent order with CloseOutGenius.com. we regret to inform you that while we strive to fulfill every order, unfortunately your order 25481-W is on a 2-3 week backorder. We do apologize for any inconvenience we may have cause you and thank you for your understanding. Then:

Gentlemen,
You will note my conversations with your staff on Sunday, March 22, 2009. When I called to cancel the additional software and purchase it with the 2007 maps, I was told that the product had been already loaded with the new software and was ready to ship, that the shipping department had it ready to go. The gentleman offered me a free case and told me the nuvimap guarantee did not apply as this was a wholesale unit. Based on this e-mail I feel that you committed fraud when telling me it was ready to go and that if I wanted it I had to take it with the expense of the additional software. I even upgraded to the 3 day expedited shipping and was told I would have it by Tuesday or Wednesday.

At this point I wish to cancel my order and do not expect to recieve any charges on my account for this misleading transaction or a credit by the end of the day. I will be calling the Federal trade Commission regarding this matter as I do not appreciate being mislead like this. I was told the unit had been prepared for shipping, requested to confirm my order and even charged more for shipping. Now it's back ordered! Gentlemen, you are liars and con artists and I believe this to be wire fraud if you charge my account. Please contact me at the address below to confirm that our business is concluded.
