In Mid August 2009 I was shopping for a NEW vehicle. I was sold a 2009 Nissan Versa at Coggin Nissan Regency on

Atlantic Boulevard
. The vehicle had around 1300 miles on it at the time of purchase, but I was reassured this was from test drives and demonstrations of the vehicle. In good faith I purchased the vehicle. Around 2 weeks later I discovered a folder in the glove compartment with a receipt and a completed NEW CAR SALES CHECKLIST from October 2008 that was signed by the previous owner and the dealership. I met with the customer relations representative (Cecille) and explained what I found and that this was a material fact that had been withheld, thus an illegal sale because had I known this vehicle had been driven off of the lot without a dealership representative and previously owned I would not have purchased this car. 


It was disclosed to me by Cecille that the 1300 miles were driven by the previous owner. I asked for $5,000 (Floridas maximum collectible amount for punitive damages) and that the vehicle cost to be reduced to reflect the fact that it is in fact not "NEW" to what it would cost as a PREVIOUSLY OWNED car. The dealerships defense stems from the notion that the title was never in the name of the previous owner so it is a "NEW" car. However, the title ownership does not indicate to the purchaser (me) the actual "newness" of the condition of the vehicle after 1300 miles have been driven off of the lot without a dealership representative. I was ripped off and feel that a court would agree that this needs to be rectified and punished to deter this type of gross misrepresentation from happening without possible consequences.

shopping for a new vehicle.


It IS possible that someone at the dealership traded-in a car and bought the new 2009 Nissan Versa and then sold it back to the dealership after the loan was quickly paid off, and then the person (or persons) involved in the initial transaction of the car split the $3,500 or $4,500 rebate that the dealership eventually received from the government, right?

It would have been an easy way for dealers all over the USA, employees of those dealerships, & others, to SCAM the government and the taxpayers of America out of the rebate money, and then put that same car back onto the lot to sell all over again, wouldn't you agree?

Callingforward, I believe that the "CASH FOR CLUNKERS PROGRAM" was in 2009, not in 2008 as you stated....

If you 'Google' this- YOUTUBE CASH FOR CLUNKERS, you'll see that the videos and articles are dated in 2009, not 2008.

Possible that the car was "repoed" ?

If the car had been repoed (because the person who originally bought it could not be financed, etc) but title had not been issued (you can check with the DMV on title status - this is what determines whether a car is NEW or PRE-OWNED in the state of FL), then Coggin Nissan DID sell you a NEW car under FL guidelines.

IF title had been registered by previous owner, then yes, it is a pre-owned vehicle

And to the person who commented about Cash-4-clunkers, that happened during the time this person bought the Versa, between July and September of 2009...not in 2008

check into WHO the previous owner was because it is POSSIBLE that this car was purchased by someone at the Nissan dealership in order to DEFRAUD the government out of "CASH FOR CLUNKERS" money that was available around that time, correct?


EXAMPLE: Someone who works at the Nissan dealership could have purchased the Versa and traded-in a car to get the "Cash for Clunkers" rebate, and then sold the car back to the dealership and the dealership and the person who bought the car could have SCAMMED the government out of the "Cash for Clunkers" rebate, right? (Wasn't there a $3,000 and a $4,000 rebate taking place around that time?)

If I were you, I'd try to find out WHO the previous owner was and get the FBI involved in this case immediately. You could have come across a government scam where FRAUD was involved to screw the TAXPAYERS of the USA, correct?

*Contact your local News stations and tell them that you might have a case of government FRAUD for them to look into, okay?

I don't know if this is against the law or not. they tried to do the same thing to me, selling me a "new" vehicle with a little over 3000 miles on it. When i called them out on the pricing, almost $2000 too much, they don't want to deal. I think it's pretty funny that in these tough times, when you have someone who really wants to make a deal, these dealerships are just shunning them! I posted my experience on here also
