It appears that CACH has reported on my CBR that they own an account of mine. It is stated on the CBR as a "Collection Account" I have never been notified of this from CACH-CACV or P.S.Lowery Law. I had to find out from J.A.Cambece Law out of Peabody Mass. CACH didn't have the balls to try and collect it first, they went right for the jugular with the sleazy firm of Cambece Law who apparently feel that the FDCPA does not apply to them or any other "Law Firm" as they stated in a recent conversation, they even went as far as to state if we tried to file suit against them they would counter and win. It appears while doing research on them they were fined by the FTC and the State of Mass. AG's office last year for several FDCPA violations. We want to file suit against this firm but don't want to settle for $1,000. per offence, we would like to compile a full list of consumers and go for a class action lawsuit where we can get $500,000... As for CACH we will be filing against them for FTC's Fair Credit Reporting violations since they are reporting this as a collection account and it is in dispute again CLASS ACTION...

Seriously, if people put NEARLY as much effort into repaying debts as they do in trying to find ways around it, you'd put debt collectors out of business. You might not like the presentation, but it's still your debt.

And as for harassment, the FTC crackdown was enough to really shake CLO up to the point where I can all but guarantee you a class action suit would never pan out again.

I'm a big believer in God and I know that people can cheat the system all they want, but in the end, we're all judged righteously. Just pay what you owe. I can't believe I have to tell people to do something they should already know to do, but pay your bill.

It truly does not surprise me that CACH, LLC didn't attempt to collect on the alleged debt. With their network of attorneys that have sold out to the legal profession, they feel that they really don't need to.

The attorney firm as been fined? Does that surprise me at all? Nope!

Yes, companies and firms like this feel that they are above the law when it comes to FDCPA and will out right tell you that the "know" FDCPA law and conform to it. Yeah right! lol...and the Golden Gate Bridge sold last week to a farmer for $3.00!

What you have to remember is this...document everything with these scoundrels! Any and all phone calls...write down who you spoke with and what was said, along with the date and time...keep a log. Any and ALL documents that they send you, KEEP THEM! You never know when they might screw up, which they do frequently. YOU have to be on the ball though.

Now, as far as filing in court. What I would do, and this is my opinion on how to handle these scoundrels, is to first send a cease all communication letter to them via certified mail. Start a file on this matter and keep excellent records, especially with what they TELL you via the phone calls you've had. Don't be deceitful and make something up, be truthful...for the truth will get them every time!

For an excellent format for the cease communications letter, go to budhibbs.com he has great FREE information on how to deal with these scoundrels! I did it, and you can too! No, you don't really need a lawyer to deal with these folks.

Back to filing in court...IF and when they decide to file in court against you, THAT is when you file, with your answer, a counterclaim against CACH, LLC. Get your facts straight, find the laws that they violated and anything that could get the case thrown out against you. Make them follow the letter of the law, and when they screw up, and they will, nail them!

Remember, CACH, LLC is more than likely the junk debt purchaser of a charged off account you had with an original creditor. Under the letter of the law, CACH, LLC, regardless of whether they bought your account, is NOT the creditor and you can force them to lose in court, or more than likely before. With me they settled about a week before trial, and they got zero, zip nadda from me. However, they had to pay their court costs, they had to pay their attorney's costs and in the end, all I had to pay was the court cost to file my answer and counterclaim. What I was out of mostly was my personal time, which I placed in the counterclaim amount of $150,000, which was mostly for the actions of CACH LLC's attorney and his office's collection practices.
