Is anyone planning a class-action suit against these scammers? I would but I don't know how and don't have time, but I would help wherever I could. How do these things work? I have a bunch of questions for anyone willing to answer or even initiate something.
- How many people do you need to begin a class action suit? And what sort of cause do you need? Are all of the postings on this site enough?
- I'm assuming you need to file in FL court since it took place in FL?
- Are there any upfront fees or does it depend on the lawyer?
- Is this a better way to assure some sort of payout/payback or should everyone try to resolve on their own for now?
- Even if payout is court-enforced later on, is it possible for these scammers to find a way not to pay?
- Would the court enforce the free gift or just restitution for any money spent trying to fulfill the offers, or does it depend on how the case pans out?
- Would any of the sponsor companies be involved either as member of the class or as defendant? (I would like to see some of these other companies sued as either punishment, lesson to be learned by other companies, or both.) I can't believe that these companies (some rather large and reputable) are still sponsors, even after several people (including myself) have complained to them about this scam. Equally surprising and upsetting is the lack of response from these companies, period.
It's time to really deal with these scammers.

I'm not an attorney, but I am a third year law student who has studied civil procedure and complex litigation. There is no minimum amount of plaintiffs needed for a class action, but the more there are, the more likely a court will certify the class. If this was a class, there would need to be a class representative that has claims similar to the entire class, and the attorney must be competent enough to take on a class action.
There are different ways that a class action can be filed, and you should talk to an attorney to figure out which one is the best - since I'm not an attorney (yet) I can't advise how this class should be filed. However, I can tell you that IF an attorney takes this and believes it has merit for a class action, he/she would likely take this as a contingency fee basis for the class.
This is all I can really tell you right now, and an attorney will not likely post on this site to solicite your business as that could be a violation of professional conduct depending on the state the attorney lives in.
Many attorneys will not charge for the initial consultation and will tell you if they will take this on as a class action.
