I am just going to add the letter that I wrote to their corporate office.
On May 24th,2011, I David had my vehicle vandalized by someone throwing a rock and
shattering my windshield on my truck, police report incident #LLV110525001794.
I telephoned the apartment complex manager immediately of the incident. She had
told me that my truck was not the only vehicle that was vandalized that night.
I told her that I would be calling the police and having them do a report. She
told me that she was sorry and that she would have security come in a little later
than usual because I had given her a timeframe. I also informed her that there
was many lights out in that area. She said that she would have security do a
light count, which to this day the same lights are out 7-16-2011. I had to call
her back several times that day...One to inform her of the incident report
number and Two, to see if she could move my spot to an open location so that I
could keep an eye on my vehicle. She called me back and gave me a new spot. A
couple days later one of the security officers caught the young boys that were
throwing rocks and they confessed that they were the ones that shattered not
only my windshield but others as well that night.
It is now 7-16-2011; I have finally been able to get my windshield replaced after driving
with it shattered. I proceeded to go to the front office where a lady by the
name of Ariana or Adrina was the only one in the office at approximately
1210hrs. She was in fact the rudest person I have ever come in contact with. I
told her that I had spoke with the complex manager about this incident and that
I would get her the receipts when I could get the windshield fixed. I also
asked about getting reimbursed for damages that happened on their/your
property. She told me "Honestly, theyre not going to reimburse you for
the damages, plus it happened so long ago". I told her that I am not made
of money and that this was the soonest that I was physically able to get a new
windshield. She said, "We're not made of money either, sorry".
I told her that I had spoke with the complex manager and what I had said about getting
her the information about the incident. She insisted the complex would not
cover it and that when incidents happen such as this, they have their own
people that do the work and that I would still have to pay for it. She insisted
that the complex manager told me that they have their own people that repair
these types of damages. I told her that the complex manager told me no such
thing. If she had told me that, why would I have had to wait to get the
windshield replaced? She insisted that she did tell me and I said no, she
didn't. She then told me that the complex manager has been there for 10 years
and that yes she would have told me. I dont care if she has been there 30
years, she did not mention to me anything about them/you having no such people
that fixed windshields or any kid of damage that happens to or within the
property. She said that the complex is only responsible about the inside of the
apartments and not the vehicles that are outside of the complex. She then took
my report and receipt for the windshield and said, "I will make a copy and
send it in, but theyre not going to cover it". I really hope that this is an isolated
incident and that other complexes do not mistreat their renters and guests in
such matters. My total bill for this is $190.00 for the windshield and the
trim. I have read the lease agreement, section 18C, and according to that sub
section it does not say acts of vandalism as a responsibility of the lessee. In
parenthesis it notes (except for damage resulting from foreseeable negligent
acts of lesser). The area whereas my vehicle was located at the time of the
incident was poorly lit. According to police statistics, poorly lighted areas
have higher crime rates. These areas are still poorly lit even after I had made
mention of that fact. Also, nowhere in the lease does it reflect that the
property has individuals that do their repairs.
I really hope to hear something soon, thank you for your time.

Why do you think the apartment complex is responsible for your broken windshield? If you think that (what you consider to be) poor lighting rises to the level of a negligent act that caused your windshield to be broken, your way off base. It seems to me that you are barking up the wrong tree here.

Is there any reason you're not pursuing the actual vandals that did the damage? They are the ones that are legally responsible for the damage to your vehicle.
