"A sale for the books" - is what a auto dealer said to me once I explained what had happened to me-TWICE! On May 31, 2005, I phoned the auto dealership-"Cory Fairbanks Longwood" after reading a ad they had in the Orlando Sentinel newspaper. I was connected to a salesperson names Michael Knight. I informed Michael that I saw their ad in the paper and wanted to speak with them before I and my family made the long trip to Longwood from Kissimmee. I informed him of my credit score, my employment, my trade-in and my limited funds for a down payment. I candidly asked him if they could help me. He then asked me to give him a couple of hours and he would get back to me. He returned a call to me and assured me that he could sell me a car and even had a vehicle in mind for me and my particular circumstances. Feeling confident and assured that they could sell me a vehicle, my family and I drove to the dealership.

When we arrived, we met with Michael and he took us outside to the vehicle he had in mind for us. As we walked outside, we saw a black on black Mazda Tribute SUV being driven out of the carwash bay. He said to us "That's your car!" It was beautiful! He told us to go take a look at it to make sure it was the car for us. We spent about 20 minutes looking it over. We loved it!

My family and I informed Michael that we indeed love the vehicle. Again, I verified with Michael my credit score and again he assured me that he had already discussed everything with the finance department before he told me to come in. I then proceeded to give him my driver license and other verification required. During this period, he continued to congradulate us on our new purchase. After the initial paperwork was completed, he took us in to the financial person, Christopher Dakers. Before Christopher began, I again asked if this was going to be 'a sale for the books' or were we actually going to be able to keep this vehicle. At this time, Christopher replied "We would never let you drive off the lot if we did not think we could get you approved. We are not in the habit of just letting people drive off with our cars". I then reminded him of my credit score, in which he replied that they did a credit check and that if he could not get bank financing, he was sure Mazda credit company would finance me. At this point, we proceeded with the contract and other paperwork.

Christopher had drown up paperwork in which I signed:Car Buyer's offer and Purchase Option Contract; a Retail Installment sale contract; Car Care service plan; Total Loss protection program; Road Hazard Tire Coverage; Odometer Disclosure statement; and the Notification of Transfer of registration license plate form. After all of this, we began to feel assured that the vehicle was ours-to keep. My children (Erica 16 and Fermond 15 who are excellent students in school) and I were so excited! My family and I work hard and we thought that this was a blessing from GOD above! I asked no more questions. We were given the keys and we DROVE off the lot in a new Mazda Tribute SUV. Before we even left the lot, my family and I were talking about being able to visit our family (and my grand kids!) back home (Virginia) whom we have not seen for over a year. A few days later, we even planned the trip home. We were so excited.

After a couple of days, Michael called and left a message thanking us for our purchase and asking if everything was O.K. Soon after, I received letters thanking us for the purchase. We even received a container of cookies from the dealership. More and more, my anxiety eased and I began to accept the blessing of our new car. However, this would all change.

After about week, we began to receive phone calls from Cory Fairbanks. I did not recognize the name left in the message. I began to feel something was wrong. When I returned the call, I was informed that they needed more information and for me to come in soon. When I inquired as to what information did they need so that I could bring it with me, they were evasive in answering the question, but assured me that it would all be resolved when I came in. This was not the case.

When we arrived at the dealership, about a week or so after purchasing the vehicle, we were directed to speak to William Comprosky. He informed us that they were unable to get financing for us and that we would have to return the vehicle. We were devastated! My children were broken hearted; just broken hearted. Not only were we lied too, but this meant that we could not make the drive home to see our family in Virginia. Mr. Comprosky made no offer of allowing us to make a higher down payment nor did he give any reasons as to why we were out right LIED to over the phone by Michael, during the initial write up, and at the signing of the contract by Christopher Dakers.

These kinds of tactics are hurtful and unfair. These dealerships are tampering with people lives. As consumers, we have rights too. These practices should not be allowed. Dealerships should be held accountable for their actions and not simply be allowed to say that "we couldn't get financing". What about the initial credit report obtained. When I asked Mr. Dakers about my score being very low, he said for me not to worry - "That he was sure he could get me financed". Although this incident happened in June 2005, my family and I are still devastated by what happened. Yet, Cory Fairbanks gained "A Sale for the Books! at our expense. Shame on you Cory Fairbanks!

At present, I desire to seek legal advice and inquire if there is a decent attorney out there who believes that this is a tragedy, please contact me concerning this "Breece of Contract". Thank You!

cory fairbanks mazda are liars!!!!

I trade in my old car for a mazda 3 hatchback 2012 at this dealership and I tild them I cannot take a 400 dolar payment...at all this they got me a deal with my trade in and they got me a payment on the 300's...after a a couple of days they call me asking for more info and that they need me to come in by the dealer...so I went to the dealer and the finance guy ( I forgot his name) told me that the financing bank didn't approve me the interest rate they give me and that they need me to sign some paper and that I'm gonna be paying 411 a month now.....I ask him "there's nothing we can do? I told u since the beginning that I can't pay over 400 dollars a motnh!!! "...and he say that there's nothing he can't do and that I need to sign...since it was the first time of me buying a car I sign the paper and got stuck with the car...at all this I still have both paperworks of the first time and second when they call me to sign...I end up returning the car cause I couldn't pay it and with my credit score on the floor...my sister in law went overthere to get a car and they did the same thing to her.

Somebody need to do something with this people cause all they do is ripping off the people and then the law doesn't help us ......never going againg to cory fairbank mazda and also don't give any kind of recomendation to otheres about this dealer

Are you aware that Overholt brags about being the biggest con in the industry?

He works with attorneys, yes, and makes a massive profit accusing others of the very fraud he committed himself.

He got immunity as he blew the whistle after it was blown on him.

I recently bought my very first new car, but my parents, having had 27 years each of car buying experience, fully educated and prepared me for what I was about to encounter.

My mom warned me that every dealership she has been to tries to have the customer sign an agreement (amid all the other confusing paperwork they are throwing at you) that is a "Conditional Acceptance of the Vehicle." This agreement states that you are taking the car home before any commitment of financing is complete.

If, for any reason, the dealer is not able to obtain the financing for you, you agree to either meet new terms or return the vehicle. This is why you must be diligent in signing legal documents. If they try to rush you (which, of course they will), remind yourself that YOU are the one hurt by entering into a contract that you do not fully understand and take the time necessary to check everything. I made the deal on my car on Monday night and they tried to convince me to take the car home that night.

I conclusively refused, telling them that I would not take the car home until the loan was approved, and if that meant waiting an extra day or two, so be it. They expect the customer to fall in love with the car during that "limbo" period and when called back in, meet whatever new terms are presented in order to avoid the embarassment of turning the vehicle back in.

It happened to my parents when they were young and they ended up with a much higher payment than they could afford. Thank goodness they taught me well. Hopefully you will be on the look out for this in the future, and make sure you teach your children before they fall prey to these common dealership techniques. Good luck! :)

Alisa,

The issue you have described is very common, do not feel singled out. Fact is, its not a "number" for a dealership until a car is bought by a bank. Credit problems can be tricky, there are alot of banks that deal with broken credit, but sometime even these secondary financing companies say no. Alot of cars are sold on a "spot", this gives a dealership a chance to find a bank that will say yes. Rest assured not business is going to let a $20,000 purchase slip from their fingers without a fight. If you were told not to worry its becuause the dealership thought they could get you approved, but they arent the banks that said no. Business is business, why would any dealership let you leave with an unbought car without a bank buying it if they thought they couldnt get it bought, if wrecked it would be there $20,000 loss. Good luck with your shopping.

Thank you for the Better Business Bureau information. I see your point. I am, however, presently waiting to hear from Local6News regarding this matter. I have also contacted LegalMatch.com and am waiting to hear from them as well. My family and I were victimized by Cory Fairbanks of Longwood. I was honest; they LIED. That's wrong. My next contact will be the state attorney's office. Thanks again for your support.

Fantastic! Please let us all know. There's one more thing I wanted to comment on. In fact, when you contact the media you might want to also point this out...

If you are to rely on consumer information, you need to be able to TRUST the source of that information, right? Perhaps you heard of the "Better" Business Bureau, or BBB. Maybe someone has suggested you contact the BBB in regards to this situation. After all, the predominate impression is the BBB is your friend, they are a consumer watchdog with very sharp teeth and not only that, they have a mediation program where you and the con man (sorry, I mean 'dealer') can duke it out in front of them and the wonderful BBB will render a decision. (How noble!) Let's look at the BBB...

Despite the fact the BBB wants you to think they are affilated with some government (state, federal or local) they are NOT! The word "Bureau" is misleading. (Imagine that, the BBB is misleading you!) If there was no attempt to mislead you, they would choose another name.
For a merchant to become at "member", they must PAY A FEE. These fees are their source of income. The BBB supposedly has a set of standards and their website, in regard to a member, says and I quote, "meet our membership standards". In your case, it is clear this dealership pulled the SPOT DELIVERY SCAM and their advertising includes the DEALER FEE CON-GAME, better known as FRAUD FEE. This dealership IS a BBB member!!! Hold onto your seat Alisa...the BBB gives them (or did they purchase it) a SATISFACTORY rating!!!!! But back to the other "service" this great consumer watchdog "gives" you...mediation. At the mediation table its you, the con-man and the BBB affiliated mediator. Of these entities, who provides income to the BBB??? The con-man, who received the satisfactory rating! Do you think this is a process based on "fairness"???

The bottom line here Alisa, how many people will check out this dealership with the BBB...see the satisfactory rating...read the BS about membership standards...then experience the SAME CRAP you did...the SPOT DELIVERY SCAM and the FRAUD FEE SCAM???? Is the BBB your friend, Alisa?
Can anyone BUY a BBB membership???

I'm sorry you have been victumized by another example of "integrity" in the wonderful car business. Let's hope this experience will be educational and from this you will become a savvy buyer.

You were victumized by the spot delivery scam. The next time, arrange your financing in advance. Even marginal credit can be arranged in advance. But Alisa, there's more...much, much more.

You're right, these practices which separate the slime in the car business from those who know what integrity means should and are outlawed. What if I told you this dealership advertises their lack of integrity? Would you go there to buy a car? Of course not! Lets look at page G7 of the 12-3-05 Orlando Sentinnel and you'll find that advertising. At the top of the ad is "$7000 Minimum Trade". Do you think and old rusted out piece of junk is worth 7k? No. The con-game in this scam is to attract the sucker, chump and doormat who will fall for this crap. If they fall for this, they are an easy mark for any other scam. Sure, the contract may show 7000 for a trade, but they will make it up in other ways. They cannot afford to "give" 7000 for a car worth 200. Secondly, when you last went to a grocery store, was the price of milk what you paid at the register? Of course it was. But lets go back to this dealership's ad...you'll see a 2006 Mazda 6 for $15,999. Go down to the bottom of that same ad and find a fraud fee of 699. They call it a "service handling fee", simply an official sounding name for the dealer fee con-game. Did they stick you for 699 as well??? This con-game works like this: they advertise a price they are NOT selling the car for and then tack on the extra 699. The 699 goes entirely to the dealership as opposed to some other entity, therefore IT IS A PART OF THE COST OF THE CAR! In other words, they advertised a partial cost.
Does that represent integrity in the car business??? The spot delivery scam and fraud fee scam are rampant in the business. You see Alisa, even before you come thru the doors, they are telling you thru their advertising what their M. O. is!

The Florida Attorney General's Office actively investigates these types of scams. They have an Orlando office. Channel 6 TV has been involved in exposing the slime of the car business, contact them. (They told us of the $300,000+++penalties paid by "Mr. Big Volume" Bill Heard. Also contact Duane Overholt (use a search engine to find his site). Duane works with lawyers as an expert witness and may be able to point you in the proper direction.

Don't let this slide. Tell everybody you know about your experience. You might even want to seriously consider picketing this operation with signs warning "SPOT DELIVERY SCAM IN PROGRESS" or how about "THEY USE FRAUD FEES".

Good luck and please DO NOT LET THIS SLIDE!!!!!
