Cosmos Travel ripoff Fraud I paid for the tickets but he never issued it and is asking for the charges Dallas Texas

I need to complain about the TRAVEL agent Who cheated me:

Issue:

1) I spoke with them and told them that I want the 3 Tickets (for Myself , my wife and my daughter) to India for 20 Nov and return 2nd Jan 2005 for myself and return for my wife and daughter was 6th feb 2005.

2) Then do to my death of my wife's sister we changed our plan and I told them I need the tickets to India for my wife and my daughter departing on 25th Sep 2004 and return on 2nd Jan and for myself I need it departing boston on 20th Nova nd returning on 2nd Jan 2005.

3) they confirmed me the tickets to India as per No.2 and gave me the itinarry.

4) On 16th Sep they encashed my check and did not issue me the tickets for the dates requested as per item 2 but issued me the tickest as per item 1.

5) Because they issued the wrong tickets, the reservation for the dates on No.2 got expired.

6) Now they are asking me
a) Cancellation amount of the Tickets they issued by there mistake.
b) Extra $641/- as now according to them is the new price of the Air Ticket.

I want to file a case on this travel agent and I need my money back and the compensation also, Because of him my wife will not be able to attend the last rites of her sister who expired on 6th sep 2004.

He is declining to refund me the full amount and says that he can refund me the amount after deducting the cancellation amount of the tickets he issued it incorrectly.
