I purchased a 99 GMC Sierra 1500 Ext Cab 4x4 from Countryside Auto on January 29, 2018.  I was driving a Ford Ranger that was on its last leg and wanted a bigger truck and one that I could use to haul with.  I told the salesman about the Ranger, told him I was looking for a truck to haul with and he said this truck was a good truck to haul with.  I really liked the truck, it had 66,071 miles.  The dealer also told me it was sold with a warranty.  So with all that information, I was sold, so made the purchase.  I also have to explain, when I went to look at this truck there was NOTHING showing the truck was for sale, other than it being on a car lot.  No Buyers Guide, no for sale sign, no markings, etc.  It even had several bags of trash in the bed.  And when we called to get a price on the truck for 2 days, they never returned our call.   When we went there to look at it that Monday, when asked how much it cost the dealer said "I don't know, it's up to the finance company". [continued below]....

.....  That should have told me there to walk away, I have never heard any car being sold based on how much the finance company says to sell it for.

During the "reading" of the paperwork, I was told the "warranty" was $995.  My mother was with me and we both were taken aback as we were told TWICE it came with a warranty.  So she asked me if I really wanted it as it would save me $995.  I told her, no not really, so opted out of that.  The man told us both, that if I wanted to buy the truck that I had to take it, that he can't sell the truck without it.  Never buying a vehicle with a warranty before we thought that he was explaining to us how much it would have been without it coming with the purchase of the truck.  So we were still under the impression, I was getting a warranty with the truck.  I understood it was a powertrain warranty, as that is what he explained it being.

The total purchase price on this truck was $7129 AND the mileage was even written down on ALL the paperwork WRONG.  Not by alot, but enough that it would make a difference on any "warranty".

Within a week the truck started breaking in half.  I told the car lot on February 4, 2018.  They just shrugged it off.   I then started looking to find out what was going on and had a couple people looking at it and was told the frame was cracked.  So I was trying to find out how to get it fixed. I had attempted to have someone weld a brace on it, but I was told over and over there was no way of putting a brace on it as it needed a frame replacement.  Then I started contacting lawyers.  

I had no choice but to start driving the Ranger again while I was trying to get another car to drive.  So I ended up having to park the truck in March 2018.  I started talking to body shops to get estimates on repair.  In March the linkage went out on the truck, assuming from the pressure of being bent.

In April 2018 the frame broke in half, where it went from being tilted toward the cab to now the bed touching the cab.  I got 2 estimates for a frame replacement $2800 and $4000.

In May 2018 I told the owner (who I actually made the purchase through) about the condition of the truck and his response was "Oh really?!?!" with the sound of his voice like he knew it.  But yet offered nothing.

In June 2018 I sent him a letter requesting him to fix my truck.  I also provide many photos with a timeline and a date to reply by....Still nothing....

So I filed several complaints (6) trying to get the truck fixed.  Including with the Attorney General and the Better Business Bureau.  The dealer sent a response to the Attorney General that he told me about the frame.  Which he did not.  The Attorney General also said the truck was purchased as is, which again, I was never told the truck was sold as is.   The same response pretty much was also sent to the BBB.  The dealer also said in BOTH letters, the reason he refused to fix the truck is because I had been defaming him.  Which is a lie.  Not one time have I ever lied about what happened and only after court did I put it out for others to know what he did.

After waiting on the response and hoping to hear he'd fix it I decided it was time to sue.  So I filed a small claims case which was held January 29,2019.  During the hearing, the dealer ADMITTED to buying the truck at an auction (I found this out after I pulled a CarFax to get more information as the one I pulled when I made the purchase was a car report but not a CarFax).  He admitted that he was told at the auction that it DID have frame damage.   He also stated that it is their office that they read to you the paperwork and that THEY sign YOUR signature.  So essentially when you agree to a line, they sign your name, apparently, they leave out things like "Oh you are buying this as is" as they did with me.  No one ever said I was buying the truck as is, I was only told it was being sold with a warranty. I never okayed my signature on the buying as is box.  So essentially, since they never stated to me I was buying the truck as is, I never agreed for them to sign my name in that box,  they forged my name in the as is box.
