we had a mortgage with novelle in october, we made the payment, a month later we got a letter that the loan has been sold to countrywide, we then made our november payment still to novelle because we were notified to late, then countrydwide sold to america servicing company sometime in december, but we already paid countrywide in december and paid america servicing in january 05. in the meantime we received a letter from countrywide that we are outstanding with 1 payment.
i then mailed them the prove of payment. i was under the impression it is all sorted out, then i was notified by my broker who is trying to close on a 1031 exchange that equifax reported that we have a 30 day late with countrywide, i said no it is not so and send them prove, now i have a letter fro america servicing that we owe them for january because they are short of one payment, beside being tired of proving to all these lenders that i dont owe them.
i then brought to novells attention that they indeed paid my mortgage payment to an incorrect account, i saw this written in pen on the top of the cheque, i then asked them to check the account number and they confirmed that the money is there, they just did not post my payment to an incorrect account but also reported this on my credit report as a late and i am battling to get this off, because novelle would not send me a letter to give to my broker to show to the lender, i really feel that this is rediculous and i need to sue the lender novelle and countrywide to placing this negative on my report.
please anyone would like to take this case or give me some advise i am desperate and have no money for legal fees.

While in the process of waiting for a responds from Countrywide / Novelle. We are making payments now to American Servicing Company because Countrywide sold our loan to them. Well, well, well, this is even worst. We mae our payment as usual on the 10th of the month.
The payment is showing on our banks statement as 'morgage payment made' thanks to the new legislation. Why do Lenders / Credit Bereau's and Loan Officer not keep up to date with this new legislation. Or at least the Lenders should understand when we as borrowers say we cannot give them a copy of the check, back and front due to this Legislation?????
Right now, I still cannot close my 1031 exchange because I have to prove not only the still reported late on my morgage thanks to Countrywide of which I will take to court, whatever it takes me, and the new Lenders who want our business and not train their staff of the new legislation.
Government shoudl impose penalties to companies who hold their borrowers responsible for 'lack of prove of payment' for not keeping up to date with the changes and system. Thanks to Citibank who told me and made me aware of that. Why is it so hard for the other Lenders to knowledge themselves as well.
That explains why companies get sued all the time. Well if that is what it takes to wake them up, they should be sued more oftem for destoying peoples credit!!!!!!!!
Right now, i am just waiting to see what happens. I am tired of this rediculous system that favors only the Lenders!!!!!!!!!!!!!

After, showing prove of payment to Citibank, and explaining that is not our fault, they finally declined our loan. Countrywide / Novelle shows no remorse and will not cooperate with what we have told them and proved to them. I am so ready to take them to court, please if there is anyone else out there that can assist me. This is so rediculous and unfair. Why is it so difficult to get justice for these Mortgage companies that destroys our life!!!!!!!Why is it ok to allow them to make mistakes, credit the incorrect borrower, and still not hear what they have done and that they have ruined our life!!!!!!!????? Countrywide / Novelle should NOT be in business, we should boycott this Lender!!!!!!

After speaking to numerous people at countrywide, we still have a problem. right now we are trying to refinance and countrywide have sold the loan to american servicing company. they want us to pay 5900.00 for late interest, despite the fact that we send them prove of payments that was made to countrywide. countrywide on the other hand the staff Nancy (debt collection), and a few other staff just simply refuses to give any information because the loan has been transfered. in fact on tuesday morning, a staff member from countrywide called me a 7 in the morning and told me they found the 'money' and forwarded it to american serving company, i asked them to send a letter in the mail, because they always lie through their teeth. to date no letter was received. we are suppose to close the refinance, final day is today and american servicing compay still did not get anything from countrywide, the title company wants us to pay this money despite proving the payments were made. we do not have this out of pocket to close, so that means the deal falls through. what do we do here, please anybody can help??? how much more do we have to prove to both american serving company and countrywide that we do not owe them anything we have prove of these payments that went through our bank account!!!!!!! i really need to sue countrywide now, i am so stressed out and angry with the way they are treating us. please anybody can help me please contact me on 707 429-5173 this is very urgent as our refinance deal just felt through dew to these people. their has to be some law protecting us from this treatment.. i will not rest until i get both american servicing and countrywide to pay for this treatment and causing me to have sleepless nights and depression, trying to figure out what more i can do.
