Let's talk about the definition of what and "independent contractor" straight from the Internal Revenue Service website:

Independent Contractor Defined

People such as doctors, dentists, veterinarians, lawyers, accountants, contractors, subcontractors, public stenographers, or auctioneers who are in an independent trade, business, or profession in which they offer their services to the general public are generally independent contractors. However, whether these people are independent contractors or employees depends on the facts in each case. The general rule is that an individual is an independent contractor if the payer has the right to control or direct only the result of the work and not what will be done and how it will be done. The earnings of a person who is working as an independent contractor are subject to Self-Employment Tax.

You are not an independent contractor if you perform services that can be controlled by an employer (what will be done and how it will be done). This applies even if you are given freedom of action. What matters is that the employer has the legal right to control the details of how the services are performed.

If an employer-employee relationship exists (regardless of what the relationship is called), you are not an independent contractor and your earnings are generally not subject to Self-Employment Tax.

However, your earnings as an employee may be subject to FICA (Social Security tax and Medicare) and income tax withholding.

Since the employer is controlling the sales calls that you make, you are not an independent contractor.  These dealerships are not following the law.

There was a decision made in New York State about the same law.  Unfortunately Filter Queen has crossed some lines. 

I believe the Filter Queen products are great but if they really wanted to be a competitive product without all the legalities and red tape, then they should be sold at Best Buy, Wal Mart, and Amazon right next to the Dyson products eliminating the middle man.

This report is completely false. I have been with the company for about 6 months now and alot of people come through the doors who expect to get paid and not work.

This is mostly sales and you are given a certain job to do within a certain amount of time. I had 3 days to do 12 presentations and I would make $400. I completed my 12 presentations in 3 days, sold my presentation to 4 out of the 12 presentations I did, and actually got paid MORE than $400 I was told I would receive. The manager actually gave me 10% of my sales during my training and it was the most I had ever made in one week.

If you don't do your job, you don't get paid. SIMPLE AS THAT. They are not a cash distributor and just hand out money to people who want something for nothing. It would be nice but honestly, I do not know of any other company who does that either. YOU HAVE TO WORK IN ORDER TO GET PAID! And thats for every job.

As far as the $200 if you don't do your presentations and the picture thing? COMPLETELY false. I have never been promised $200 for doing nothing in this company. AGAIN, I say, you have to work in order to get paid with any job.

I get paid every week, with commision, and with gas allowance because I do my job description to a T. This is the best pay I have ever received and I basically do my job on my own time. Also, my managers help me every time I ask. It doesn't get any better than that in my book. One thing about me though, I am motivated, I have a drive, I am not lazy, and I know things in life don't come free. You have to work for it. IT WOULD BE SO GREAT IF MORE PEOPLE UNDERSTOOD THAT!

So for the lieing and lazy people who have nothing better to do than get mad because you want to write false statements AND get paid for doing absolutely nothing, good luck to your next job. I bet you won't keep that one either.
