I want to report a violation of rgihts fort cuban agencies,last month I rented a car for 14 days,I send all the documents that they requiered,I started with the rent three days before my treep,but qhen I paid the amount was higher than I saw in the begining,I inmidiatily ask for cancelation, six hour after I paid.They said that it was late and they can't do anything for mi,but if wanted I could send a fax with the word cancelation,but it had fees. Naturally I didn' do in,and I send another document that they need.When I arrived to Cuba I started to looking for my car,the car was not in any place,I contacted the person by email,and they said that I cancelled it,and took me 400 and reinburse me the other amount,I only want that people know that do bussiness with cuba is the worse thing that people can do.

In response to the report filed the chronological order of the booking is as displayed below. For veracity of fact, the replies from the client are provided “as-is” as her communication with us was in Spanish however this report has been filed in English.

Prepaid Booking - received and confirmed 03/07/2014 06.11am ET

Confirmed Booking collection date: 07 July – Location: Manzanillo

Communication with the Client

03/07/2014 – 06.52AM We wrote to the client confirming the sale had been approved and the vehicle confirmed.

Client Reply - 03/07/2014 – 11.22AM “quiero rechazar la transacción como debo hacer?”

03/07/2014 – 11.34AM We wrote to the client requesting if this meant that the client would wish to cancel

Client Reply - 03/07/2014 – 11.53AM “Por favor digame k puedo hacer para cancelar la transacción”

03/07/2014 – 1.56 PM Refund request processed and request made to Cancel prepaid service.

08/07/2014 – 4.17 AM Refund received and applied to client’s credit card.

The terms of sale are visible on the website, during the payment process and, lastly, MUST be read & approved (ticked) at final payment check. These terms state that cancellations of prepaid Car Bookings are subject to an 11% cancellation fee. Card & Exchange Fees (if applicable) are non refundable.

The client was refunded correctly and well within the stipulated 14 day window we are allowed to process refunds.

We appreciate that naturally, no consumer wishes to pay cancellation fees. However, these are contingent on just about every aspect of travel bookings, whether it is hotel, flight or any one of a myriad of services tourists may require. It is for this very reason that they appear clearly in the terms of sale and these MUST be approved by the contracting individual before they are allowed to make payment. They appear also as a deterrent to those who may be making a booking they are unsure about, presenting a final reminder of the charges that will apply if they change their mind or unforeseen circumstances affect their ability to travel. For these and other instances, we offer third party travel insurance which covers these eventualities plus, any and all cancellation fees. No insurance was contracted by this client.

We are aware that the goal of this report is to somehow obtain relief from those terms approved and recuperate the aforementioned cancellation fee. However, under the auspices of fairness to other clients, we will not concede to altering those terms approved by this client as a remedy against clients filing unjustified complaints.
