Custom Training/ Michael Ranieri in Union, NJ is a fraud. I signed on with Custom Training and soon discovered it was not worth the high price I paid for 'personal training'. The website claimed to give all kinds of services and all it was was one trainer who only cared about money. During the winter months there was no heat in the facility and Michael Ranieri didn't want to turn on lights b/c it would 'cost him too much'. Working out at 6am in January, it's dark. He never once engaged in work-outs like previous trainers I had. Michael Ranieri just sat and 'watched' in-between tending to his personal business.

Several attempts to receive a refund from Custom Training/Michael Ranieri I wrote a letter to the Better Business Bureau. In the mean time I asked to be scheduled for sessions (not to lose my money). Here is a copy of the e-mail I received for the owner of Custom Training:

"you reported Custom Training to the Better Business Bureau and the case was CLOSED. Since you did that, I am deciding to exercise the policy on the contract and cancel your contract."

Nice...retaliation by and owner, don't you think. Michael Ranieri is a terrible trainer and even worse business man. Don't get caught up like I did. There are MANY better personal trainers at less money then this jerk.

I think its awful that his only rebuttal to every negative post regarding his training methods/facility relate to "lazy" or "just doesn't want to train". I think if one spends $3000 to train, you want to train and expect professional services. The only reason people leave is because they realize he is not professional or interested in helping his clients reach their goals, but rather keep lights off for expense purposes and checking his email.

The post above was the second report to the BBB in NJ in under 6 months. You'd think someone would look into this!!!!

This person, Carolyn McIntyre, signed a contract for a year program
of personal fitness training. She was well informed of the committment and the no-refund and non-transferral policy.

With regard to Miss McIntyre, she decided to sign up for the 6 month program, then upgraded to the 1 year plan with full payment in advance. I clearly stated to her that once she signs up for the program and signs the contract for the terms and payment, there was no refund and no transferring.

The contract states:

CLIENT'S RIGHT TO CANCEL:
This agreement represents the entire agreement of training with Custom Training, LLC, hereafter referred to as the corporation and no other representations are made than what is agreed to in these agreements. In recognition of the possible dangers connected to any physical activity, the Client agrees to indemnify the corporation, its officers, agents, employees or trainers for all costs incurred in respect to any legal action involving the client or any person in care of the client. The client's failure to use the training package will not relieve the client of payment nor will it entitle the client to any refund for unused sessions. This training package will expire 60 days after the last attended session, or by the expiration date listed above, whichever comes sooner. This agreement shall be interpreted and enforced pursuant to the Laws of the State of New Jersey. This Agreement binds all successors and assigns of Custom Training, LLC. and the Client.

Training Agreement Cancellation: Other than provided for in this agreement, the Agreement cannot be cancelled or transferred and is non-refundable. The client acknowledged having read and understood this Agreement and has received a completed, signed copy of the Agreement.

Also, the contract states:


If the cancellation is made less than 24 hours prior to the scheduled session, you will be charged for the session. Furthermore, failure to show for a session, including for reasons which are beyond your control (e.g., traffic, accidents, etc.), are not the responsibility of Custom Training, LLC and you will be charged for the session.

** PLEASE NOTE**
THIS POLICY WILL BE STRICTLY ENFORCED. THERE ARE NO EXCEPTIONS.



She agreed, filled out the contract and signed it. The sessions were taking place and periodically I asked
her if she was happy with the program. She told me, Yes I am.

After six months of the program into the program, she would schedule sessions and not appear for her appointment. According to the contract, she required to give 24 hrs notice. She would never give 24 hrs notice and wouldn't even call. She would text my cell phone with one-word comments after the fact such as, "was out late....drank too much.." Finally after numerous times of not showing up for her sessions, she sent email stating "she needed to take a break from the sessions and she wasn't feeling it..." I called her to motivate her to come in and continue her sessions. She did for a while and then stopped appearing for her sessions again with no notification. I would, then, email her to try to schedule her future sessions. Getting a response from her was becoming extremely difficult. I am running a business whereby I need to be able to schedule clients a week in advance and if I cannot get a hold of a specific person, I need to schedule the open slot with another person. I made numerous attempts to contact the individual and would sporadically get one word suspect answers as to the confirmation of the schedule for the following week.
Finally, I emailed her telling her that she needed to communicate with me regarding setting up her schedule for future dates. She emailed me back stating that "she did not like training with me anymore and she wanted a refund." I told her that according to the contract she signed, there was no refund. She then told me "she was going to sell her program on EBAY". I communicated back to her that according to the contract she signed, there is no tranferrability to another person. She, then, demanded that I schedule her at 6am on Tues and Thurs at 6am.. I told her "that I would do my best to accomodate her requirements for those days and times, but need some flexibility with other days and times in the event I needed to switch persons". She said, "No, Tues and Thurs at 6am..period!" I could not agree to her demands because the schedule of my business requires flexibility. Also, she missed MANY appointments and it clearly states in the contract she signed:

"Your contract with Custom Training does not guarantee a specific session time. However, as a courtesy to you, your trainer may reserve a particular time slot for your training sessions. If you miss more than 3 sessions within a two-week time period, then the trainer may, at his or her discretion, reassign your time slot to someone else. It will then be up to you and your trainer to agree upon another convenient schedule for your remaining sessions."

I tried to convince her via email to continue her program and she scheduled sessions and never showed up for them either.

Basically, she is not interested in participating
in her personal training program and is just trying to get a refund for something that she was well aware of not getting a refund or transferring.

I tried many times over and over again to accomodate her. I said there will be no refund and that is the company policy. Once someone signs a contract for training, there is no refund. The policy is for each and every client that comes in and signs up.

Two weeks ago, she scheduled sessions and did not show up. I agreed to accomodate her schedule but her inflexibility and absenteeism has precluded her from benefiting from her program. This person has tried to find ways to get out of the contract SHE knowingly and willingly signed. She even went to the Better Business Bureau and filed a claim and the case was CLOSED due to the fact there was no harm done. She just doesn't want to exercise and is trying to get her money back.
