Dane v Geico 1/31/2013 Las Vegas Court
Dane denied on auto theft claim and is currently pursuing a bad faith claim. Severely flawed ignition forensics in which ignition was never removed, disassembled and examined under a microscope. Yet the same firm in the 2011 criminal case in Stockton, CA, did in fact remove the ignition in People v Roth on the same exact style locks. The forensic firm's conclusion was the vehicle was last driven with a key of the proper type. There are two problems here. One can't use 2 different methodologies and reach the same conclusion.
The second problem is less obvious. There is no definition of a key of the proper type. Always assumed to be the insured's, however without proper testing of the computer system, which was not doe on either, it could be a thief's key (easily duplicated from public VIN, and can be programmed with equipment for as little as $350.00 on a Chrysler product. Programmers are available to anyone on the Internet. The forensic firm is North American Technical and Forensic Services in Las Vegas, NV. Geico, Infinity and others have used their services for years to deny claims. For years, I have demonstrated that this forensic locksmithing has been a con.
