In 2012 I was illegally pulled over. There is a lot to the story from beig illeaglly pulled over, to the cops lying, tampering with the camera video, to assualting me. Im gonna try and make this as short as I can. In order to cover up the illegal pull mover by Highway patrol and the assualt, one thing the the officer did was claim he seen me swallow drugs, so I was taken to the hosptial, the hospital did test to see if I had swallowed drugs and blood test to see if I was on drugs or had been drinking. The test came back that I had swallowed nothing and the blood test for drugs and achocol were negative. Furthere the police also drew blood and sent my blood to the state lab and it came back negative too.
When I was at the hospital the doctor told the police that I hadn't swallowed anything and the my blood test came back negative. Because of this the cops released me. Over a year later I was pulled over and found out that the cops charged me with a DUI anyway, and the driver license division supended my Utah license. When I went to court I found out the prosecuter refused the case against me because of my negative blood test.
When I was pulled over I wasn't a resident of Utah and hadn't bee since 1996. I came to Utah as much as I could as Im from Utah my family and my kids live in Utah. I had turned my Utah license in when I moved away. The driver license division sent a letter informing me I needed to request a hearning within ten days, but they sent it to an address I hadn't lived at since 1996. They also sent a letter to my sons old address, becausec I had the car I was driving whe I got pulled over registured in Utah at my sons address because he was using it. Thwew car was impounded and I didn't have the funds to get it out so when my son moved we didn't give the DLV a new address.
Every since I found out that the driver license division fined me and put a DUI on my record in I ahve called them explained what happened and asked them to remove the fines and DUI from my record. Its costing me a lot in insurance being higher and I can't get a drivers leince without the 400.00 dollar fine being paid. I moved back to Utah recently and wrote Dave Tafoya , I was told he was the head of the hearings on DUI's, Because I didn't request a hearing within days he will not remove the fine or the DUI from my record even though there is no law that says he can't. If I had known the cops charged me anyway and that the DLV was gonna suspened my UTah license, ( even though I didn't have a UTah licsence since 1996, I can't get one here because they supended it and I can't get one in any state now.)
When your innocent and blood test prove it, you would think the DLV would remove the fines and DUI from your record even if you didnt request a hearing, at leaste if you didnt know you had been charged with a DUI and you lived out of state and didn't any letter telling you to request a hearing. You would a city offical like Dave Tafoya is for the city of Roy as well as working for the DLV would want to see that justice is done, and do something.

I was pulled over for not having mudflaps on my jeep cherokee. This is a vehicle I kept registered in Utah because my son needed a 4x4. The car was not required to have mudflaps, and I told the cop that and that he pulled me over illegally. I'm not gonna get into everything that went down that day The cop that pulled me over said he seen me swallow some drugs, so he called EMT's to the scene and they took me to the hospital. At the hospital they did blood test on me to test for drugs and alcholol, and an ultrasound to see if I had swallowed any drugs, My blood test came back negative and my ultra sound showed I didn't swallow anything. At the hospital the cops also drew blood and sent it to the state lab, that test also came back negative. When the doctor told the cops my blood test were negative and that I didn't swallow anything, the cops told me I was free to go.
The cops filed charges for DUI against me later on, and charged me with a safety violation, for not having mudflaps to. I don't know when. I was back in Utah about a year later and pulled over again, I was charged with driving on a supened license, even though I had a valid colorado license. Thats when I was told my Utah drivers license was supended. It did make sense to me because I hadn't had a Utah licsene since 1996. But apparently even though my Utah license had not been renewed because I hadn't lived in Utah for many years, they can still suspend it so that if I were to move back, or try and get a new one in another state, like when my colorado licsene expired I couldn't get it renewed. I was arrested for driving on a suspened Utah license. When I got out I set up a court date, when I went to court the judge told me that the prosecutor refused to prosicute me for DUI because of my negative blood test, but I still had to deal with the no mudflap charge.
In Utah if your charged with a DUI, the drivers license divison sends you a letter, advising you that you have ten days to request a hearing, if you do not request the hearing your drivers license is atomaticly supended. Since I didn't know the cops had charged me, and I didn't get the letters from the drivers license division, because the addresses they had on file for me, was one, the house I sold when I moved out of state in 1996, andtwo the address that I had the jeep registered at was my sons adress. I didn't get my jeep out of impound, and my son moved from that address, so I never gave the DMV a new address.
I have moved back to Utah. I have been trying for two years to get the drivers license division to remove the fine they assessed against me for being charged with a DUI, and the DUI removed from my record. There is no law prweventing them from removing the almost 400.00 fine and the DUI on my record and lift the suspension. But they have refused because I didn't request a hearing within 10 days from when the cops charged me with the DUI. They don't care that I didn't know the cops went ahead and charged me. Cops don't have to charge someone at the time of an alleged incedent, they can charge you later and thats what they did to me. The DLV doesn't care why I didn't get their letter letting me know I needed to request a hearing with 10 days from when the cops charged me.
I don't know how to explain this any better. The person at the divers license division who has the authority to remove the fine, remove the DUI from my record and lift the suspension wouln't do it. I have to pay higher insurance and have to go through a company that takes people with DUI's on their record not all insurance companies do.
one last note. The prosecutor in the case against me for driving on a suspended Utah license asked the judge in that case to dismiss the case against me, because, after reviewing my evidence he felt it was in the interest of justice that the case be dropped and the judge agreed. I hope this makes more sence to you.
