Stay away from Mr. Custom Home Builder.  While building his "dream home" next to mine, he spray-painted my decks, bannisters, and concrete, stating "not to worry...we will take care of any and all problems".  He paid his workers, moved in, and never bothered to clean up my property.  As a retired 62 yer old, I had to repaint my bannisters, but I am unable to remove the spraypaint from my wrought iron fence or concrete.  Please stay away from this "contractor" - he does not know what he doing and definitely does not care about how his actions affect anyone else.  If anyone else is harmed by this scammer, please let me know ... my attorney would love to file a class action suit against this con artist!

My attorney has offered to walk me thru small claims court, because in TX, you must file thru SCC if damages are less than $10,000.  Since I believed the contractor initially, I did not take PRE photos, I only have "after the fact".  I got my butt on a ladder and did the repairs myself, so all I have is a receipt for a can of paint, brushes, and sander.

I am not willing to go to court by myself and fight this scammer - but I do want to gety the word out on him, so that if enough folks are harmed, then it will be worth "court".  You must not be too familiar with the statues, because it may be easy to say "I will see you in court", it is another matter to pay thousands of dollars to drag him into court. 

I am open to any other ideas!

Unfortunately, when all this started, I believed what the contractor told me.  I took no before pictures and only have pictures of "after the fact".  The attorney is willing to guide me thru small claims court, but I do NOT want to deal with these idiots.  In TX, you must go through small claims court if damages are less than $10,000.  Since I got my butt on the ladder and did the paint job, I only have a receipt for the d**n paint, a sander, and a few brushes!  I am NOT interested in any money...I just want to make sure that people are aware of this scammer.  If he does this to enough folks and it results in a class action lawsuit, that  will do the trick...and keep me out of court!  Truth be told, I would probably lose it in court and be placed in restraints, I am so d**n mad!

Class Action Lawsuit..

Gees...if you really have an attorney how about telling them to forget the Class Action Lawsuit and just sue the company for YOUR damages. 

Has your attorney attempted to contact his company to get them to take care of the issues?  If he has what did they say?   If they haven't...again you need to fire your attorney because he is only out for money.

Because there is really only one set of people that win in a Class Action Lawsuit...the lawyers.  Yes, if you became the primary plantiff you may come out okay.  But anyone else who comes in as member of the class would be lucky to get enough for a nice dinner out.
