Texas Homestead Theft, Bait and Switch using Mock Dockets in Denton County 442nd District Court (Family Court), cover-up state agencies using Exact Name Match changes allowing Homeowners Associations and debt collection companies owned by law firms take homes depriving homeowners Due Process to defend their home in a legal court of law with jurisdiction.  

Tiffany Haertling on March 2, 2015 in her unofficial capacity as Denton County 442nd Judicial District Court Judge, Denton County, Texas signed a false (Lien), Order for Service using Family Court cause number, under false Rule 106, T.R.C.P. false jurisdiction in the 442ND Judicial District Court of Denton County, Texas. 

All records in the custody of District Clerks Office hidden from public viewing records, no official file stamp instead typed filing date of December 3, 2015 for Case Type, foreclosure without citation, petition, motion, affidavit, legal action letter of authority. Denton County District Clerk Sherri Adelstein Denton County, official stamp missing on Citation December 3, 2015 missing official file stamp, with false Rule TRC 99 and 106 using Family Court cause number. 

Without supporting documents, using family court cause number they drop the defendant for respondent and remove the middle initial not allowed in family court, to create Exact Name Match issue creating an Oral Hearing to determine who owns my home the applicant or the respondent without a middle name to deny me Due Process in the courts.  

  Roberts Markel Weinberg Butler Hailey PC, debt Collection Company using a fake Citation December 3, 2015, based on false Rule TRC 99 and 106, assigned a family court case number, listing Respondent removed middle initial not allowed in family court.  Jurisdiction in 442nd Judicial District Court not filed stamped In Denton County 442nd District Court, Denton County, Texas.  Created for Oral Hearing to determine ownership of my home between Applicant Legends Texas Homeowners Association, Inc.  and Respondent without a middle name. 

This is not a civil matter, missing petition, affidavit letter of authority from Legends Texas Homeowner Association, Inc. seeking a lien against my home.   Roberts Markel Weinberg Butler Hailey PC, debt Collection Company using a false Petition with no date, jurisdiction In The District Court of Denton County, Texas _____ Judicial District (Missing district number), attached to the March 2, 2015 Order for Service assigned Family Court cause number without citation, missing, motion, affidavit, no letter of authority from Legends Texas Homeowners Association, Inc. authorizing legal action, no filing fee. 

Type of cause: foreclosure, based on lien received.  No lien received, cover-up for December 3, 2015 Family Court citation     Roberts Markel Weinberg Butler Hailey PC, debt Collection Company, conspired with Classic Property Management, Legends Texas Homeowners Association Inc., Denton County Tax Assessor Collector Property Tax Department, Spindle Media (IT Vendor), Denton Central Appraisal District, Denton County District Clerk Denton County, Denton County 442nd District Court Staff, Constable Michael A. Truitt Denton County Constable Pct. 2.  Using Exact Name Match disputes between agencies, Family Court and fake district courts 442ND and 442th to take my home protected by Texas Homestead Law without legal debt or authority from the current board of Legends Texas Homeowners Association Inc.  

Details of Texas Homestead Theft, Bait and Switch, using family court Oral Hearing 5/15/2018 switching from plaintiff and defendant to applicant and respondent with Exact Name Match Issues, Mock Docket to take my home changing the homestead owner with Denton County Tax Assessor Collector Property Tax Department (Removed my name changed name of property owner). 

Denton Central Appraisal District (Refusal to send 2018 Certified Appraisal roll listing name of Homestead owner for 2018) allowing someone else to claim my property, replacing the tax payer name and changing the certified appraisal roll in the name of a person pretending my home was purchase via foreclosure as follows:     Due Process Violation will be filed in Federal Court regarding Mock Dockets published on Family Court, Denton County, 442ndDistrict Court, State Agencies using Exact Name Match Disputes, false Oral Hearing applicant and respondent dispute over home ownership, false T.R.C.P. Rules granting jurisdiction in false courts 442ND and 442th to rule over me and my Homestead home:   With malice Denton County District Clerk Denton County, Maribel Villarreal Civil/Family Assistant Department Supervisor, refusal to reply to my online form filedAugust 23, 2018 addressed to Sherri Adelstein District Clerk, requesting removal of the false information and docket against me and my home without official file stamp. 

Using the name of the respondent in the false family court case to avoid responding to my request to remove the false docket. New 11/5/2018, request to remove this mock docket sent online form to JoAnn Price Civil/Family Department Supervisor addressed to Sherri Adelstein District Clerk requesting removal of the false information and docket against me and my home without official file stamp. 

Using the name of the respondent in the false family court case to avoid responding to my request to remove the false docket. With malice to harm me, Ali Silva Court Coordinator Denton County 442nd refused to schedule Notice of Hearing on my Motion for Dismissal to cover-up court order could not be signed because no citation or petition was filed against me in Denton County 442nd District Court.  

With malice false citation on December 3, 2015 missing Denton County District Clerk Denton County, official stamp, Kelly Smith Deputy Clerk issued a citation using family court cause number, missing the Rule T.R.C.P. with false TRC 99 and 106.  Using family cause number removes the middle initial from the citation not allowed, and T.R.C.P. Rule 107 Return of Service missing.  

With malice to harm me, Ali Silva Court Coordinator Denton County 442nd District Court refusal to schedule my April 8, 2016 Motion for Dismissal – Texas Rules of Civil Procedure Violation, Texas Rule of Civil Procedure, Rule 106 (a),(1),(2), 107 (a),(b),(e),(f),(h) and 108.   The Legends Texas Homeowners Association Inc. current board, Robert Umphred President never requested nor received a motion overruling homestead law granting Assessment Lien signed by 442nd Judicial District Court Judge Tiffany Haertling against my home regarding a case filed in Denton County 442nd District Court .   

  Participation of Classic Property Management:   With malice Jamie Patterson within one month of becoming the new property management firm, Classic Property Management, altered the records of outgoing property management firm.  Listing my first name with an initial making it appear as a middle initial.  Classic Property Management stopped inviting me to The Legends Texas Homeowners Association Inc. monthly meetings.

With malice Classic Property Management, allowed Roberts Markel Weinberg Butler Hailey PC, debt Collection Company, to schedule a meeting (September 19, 2017) pretending it was The Legends Texas Homeowners Association Inc. Participation of Roberts Markel Weinberg Butler Hailey PC, debt Collection Company: With malice Sipra S. Boyd with Roberts Markel Weinberg Butler Hailey PC, debt Collection Company, false claim of legal Action sent on their letterhead without notice or approval from the Legends Texas Homeowners Association, Inc. With malice Sipra S. Boyd of Roberts Markel Weinberg Butler Hailey PC, debt Collection Company, created a Mock Docket, sent false letters of legal action sent from Arizona using Expired bulk mail envelopes.

With malice conspiring with Jamie Patterson of Classic Property Management and Robert Umphred President, Legends Texas Homeowners Association Inc. to seize control of my Home with altered records and preventing me from attending homeowners monthly Meetings. Roberts Markel Weinberg Butler Hailey PC, debt Collection Company sent a letter of redemption without authority pursuant to Texas Property Code 209.011, this is in violation Of Homestead protection and with no legal description of the property or it’s authority granted by a court of law to seize or foreclose on my property.

Roberts Markel Weinberg Butler Hailey PC, debt Collection Company is not an HOA authorized to send a notice of redemption 180 day to redeem my property.   The company can only receive authority pursuant to 209.011 in a civil court based on debt It holds and petition to claim rights based on a debt.  

The company is not allowed to add two names not listed or change plaintiff without civil proceedings to respondents in a family court matter and what authority it has in the matter.  The company must identify the cause number and copy of court order providing legal authority the right to seize my property. 

Roberts Markel Weinberg Butler Hailey PC, debt Collection Company made false claim the company filed an Order of Sale pursuant to false Rule TRC 309, 310 646(a) filed in a Family Court in favor of a applicant not listed and respondent not listed and missing Denton County District Clerk Denton County, official stamp.   Roberts Markel Weinberg Butler Hailey PC, debt Collection Company never requested nor received authority to seize my property with an official file stamp from a civil or family court anywhere in the United States.                                            

     Participation of the Legends Texas Homeowners Association Inc.: The current, Legends Texas Homeowners Association Inc. President Robert Umphred never received nor authorized a request for Assessment Lien from Classic Property Management regarding dues issues on my home. Classic Property Management, altered the spelling of my first name adding an initial Making it appear to be my middle initial and stopped inviting me to HOA monthly Meeting, to cover-up Roberts Markel Weinberg Butler Hailey PC, debt Collection Company attempt to steal my home in violation of Homestead Laws.       

  Legends Texas Homeowners Association Inc., board president Robert Umphred never received authority from a court of law in a civil action matter to send authorized notice of redemption pursuant to Texas Property Code 209.010 providing me with 180 Days to redeem my property describing the legal description on the letterhead of the HOA.

Legends Texas Homeowners Association Inc., never requested nor received authority to seize my property with an official file stamp from a civil or family court anywhere in the United States.   Participation of Denton County, 442nd District Court (Family Court):   Records department allowed Roberts Markel Weinberg Butler Hailey PC, debt Collection Company without authority to represent The Legends Texas Homeowners Association Inc.   Filed Mock Docket for two fake courts 442th Judicial District Court and 442ND Judicial District Court) filed in Denton County, 442nd District Court, claiming false ownership of a debt to seize my home in violation of Texas Property Code Title 5 Exempt Property and Liens, homestead property protection.   

  Denton County 442nd District Court refusal to schedule my April 8, 2016 Motion for Dismissal – Texas Rules of Civil Procedure Violation, Texas Code, Rule 106 (a),(1),(2), 107 (a),(b),(e),(f),(h) and 108. To cover-up Roberts Markel Weinberg Butler Hailey PC, debt Collection Company claiming false ownership of a 2009 Assessment Lien (Cured, Paid in Full in 2010) to seize my home.

The Legends Texas Homeowners Association Inc. current board, Robert Umphred President never requested nor received a motion overruling homestead law granting Assessment Lien signed by 442nd Judicial District Court Judge Tiffany Haertling against my home regarding a case filed in Denton County 442nd District Court . 

  Michael A. Truitt Denton County Constable Precinct #2   Used unsigned letters without his signature missing Denton County District Clerk Denton County, official stamp, claiming Roberts Markel Weinberg Butler Hailey PC, debt Collection Company obtained the right to seize my property with Order of Sale pursuant to false Rule TRC 309, 310 646(a) filed in a Family Court in favor of a plaintiff not an applicant not listed in the December 3, 2015 citation listing a respondent not listed.

The Order of Sale indicates the foreclosure on the Assessment Lien was obtained at an Oral Hearing held 5/15/2018 in a family court listing a plaintiff not a respondent Sent Constable Sale notice without signature of authority claiming notice to sale per jurisdiction in in a different court from 442nd to a false court 442th Judicial District Court of Denton County.

  Denton County Tax Assessor Collector, Exact Name Match changes:   IT vendor, Spindle Media without legal authority, alters records received from Certified Appraisal Roll: Without authority, Spindle Media alters the legal homeowners name, address and account number. Spindle Media alters the format of the homeowners last name printed first by removing the comma after the last name which identifies it as the last name is printed first.

  If you remove the comma then the last name must be printed last, this changes the name of the owner.   Spindle Media alters the legal Situs address location by adding three zeros, 000.  On the mailing address they remove the 000 zeros.   Stacey Dyoracek Supervisor stated Denton County Tax Assessor Collector,  gave permission to the contract vendor Spindle Media to remove the comma after the last name printed first, because it’s an inconvenience to your office.

  Stacey Dyoracek stated she would contact legal department to see if this could be changed to match Denton Central Appraisal District file sent to the Tax Assessor Collector office.  We met With Stacey Dyoracek on Aug. 8, 2018 to this date no reply. On Aug. 8, 2018 Michelle French sent an email changing the subject about Spindle Media removing the comma after the last name printed first, on a legal document identifying the property owner, legal description of the property location and account number adding DEN.  

Not a single reply listing laws, regulations, policy giving Spindle Media and the Denton County Tax Assessor Collector the right to alter legal description on the Certified Appraisal Roll received from Denton Central Appraisal District.

Regarding foreclosure on my home all events recorded in the Denton County 442nd District Court docket,

based on events in a mock docket created in pretend courts Denton County 442ND and 442th District

Courts created to prevent me from claiming my home as the owner.

 

Regarding foreclosure on my home, no records manager or clerk associated with Denton County 442nd

District Court, Denton County Tax Assessor/Collection (Property Tax Department), Denton Central

Appraisal District, or Michael A. Truitt Constable Pct. 2 Denton County, is able to explain who entered

the events in the live database for Denton County 442nd District Court or why there records in the live

database support taking my home.

 

Using a training database created by contract vendors, used for employee training, update testing,

debugging etc.., court employees created mock dockets with supporting documents (Motions, Citations,

Petitions, Court Orders, Judgments etc…) filed in pretend court 442ND and 442th etc… someone

associated with court records created a mock docket in the training database and entered it into

the live data base for the Denton County 442nd District Court. 

 

On March 2, 2015 an Order For Service with false court rule and contained instructions for substitute

Service in the body and instruction for a specific person to deliver the original citation and petition

before December 3, 2015.  The court with jurisdiction listed as a pretend court 442ND Judicial District

Court of Denton County Texas Tiffany Haertling Judge Presiding without a file stamp, typed filed by

Denton County District Clerk, JoAnna Price Deputy Clerk and Kelly Smith Deputy Clerk.

 

Denton County Tax Assessor/Collection (Property Tax Department) using training database created by

their contract vendor altered the owner of my home and used the mock docket with pretend court

442ND and 442th training database used by court clerks to illegally enter into Denton County

442th District Court live database to take my home.  Without foreclosure against my Deed, property Tax

Department identify the owner of my home is Kevin Christopher Alaimo, owner of StarCrest Realty.

 

Denton Central Appraisal District used the training database to block sending my 2018 Certified Appraisal

Roll with my name as the legal owner.

 

Kevin Christopher Alaimo, owner of StarCrest Realty, using his connections with CoServ to place a

Deposit on our Gas and Electric account number September 29 2018.  Allowing him to claim he owns the

account and the Property Tax Department identifying him as the owner, and appraisal department

refusal to provide a 2018 Certified Roll listing me as the owner.  This is allow Kevin to claim my home

under homestead rule of abandon home (Owner cannot be found), he never received a Constable or

Sheriffs Deed against my Deed.

 

Michael A. Truitt Constable Pct. 2 Denton County used the training database with pretend court 442th

making a false claim to sell and seizure my home using fake deputy R.W. Rhodes to serve. Using a

false auction date and notary date of September 5 208 (This is not a typo September 5, 208). And no

attempt to foreclose on my recorded Deed.

 

Classic Property Management altered the spelling of my name changed the first name adding an initial

making it look like a middle initial.  The Legends Texas Homeowner Association Inc. stopped inviting

me to monthly homeowners meets pretending i don’t own the home.

 

The training database used to create the mock docket and pretend courts 442ND and 442th recorded in

Denton County 442nd District Court live database on December 3, 2015 by court clerks.  Used by

attorney and Sipra S. Boyd (Texas Bar No. 24027903) and Sandy Huynh (Texas Bar No. 24057454)

pretending they represented a (Plaintiff and Applicant) Legends Texas Homeowners Association Inc.

 

Sipra S. Boyd and Sandy Huynh, represented Roberts Markel Weinberg Butler Hailey PC a debt collection

company owned by a law firm with the same name pretending to be a law firm whereby its employees

Sandy Huynh (Texas Bar No. 24057454) and Sipra S. Boyd (Texas Bar No. 24027903), false claims to file

Citation and Petition in Denton County 442nd District Court represents Legends Texas Homeowners

Association Inc.

 

Sipra S. Boyd never filed a Citation with Petition, Affidavit, Evidence on December 3, 2015 in the 442nd

District Court of Denton County, Texas.   The Legends Texas Homeowners Association Inc., never gave

written authority to take legal action against my home per the mock docket dated December 3, 2015.

 

The Cause No. is missing a case number and Legacy CVCM Track number no recording location by

volume, /book IMG. Page.

 

Based on the December 3, 2018 mock docket on 4/18/2018 file sent to Records Management (storage) a

Motion for an Nunc Pro Tunc on 4/27/2018 Oral Hearing the Order of Sale was issued after the case was

closed on 5/25/2018 Final Order/ Judgment /Decree (Closes Entire Case)  On 6/22/2018 Order of Sale

sent to attorney returned due to clerical error.

 

No recording on closed mock docked 7/30/2018 in a letter Michael A. Truitt Constable Pct. No.2 claiming

he will hold a Constable Sale on September 4, 2018 per the Order of Sale from pretend court

442th dated 7/5/2018, this is impossible the closed mock docket indicated the Order of Sale was issued

on June 22, 2018 and served on the attorney on September 10,2018 after the sale on September 5,

2018.

 

On July 31, 2018 a person named M.W. Rhodes (This is not a Deputy Constable or Deputy Sheriff for

Denton County) claiming the Notice of Seized property was posted.  Homes are not sold on this day

and Officer Return not filed because  the mock docket is closed.

 

On September 5, 2018 Constable Michael A. Truitt claimed he sold my home, no homes are sold on

this day and its notarized September 5, 208 (This is not an error it’s notarized September 5, 208).

 

Sandy Hundy (Unsigned) Abstract of Judgment issued May 16, 2018, based on a judgment issued after

the case was closed May 15, 2018 and before (Request for Issuance of Order of Sale) dated June 19,

2018.  on The mock docket indicates the Abstract of Judgment based on a judgment Creditor Legends

Texas Homeowners Association Inc. Constable Michael A. Truitt never field Officers Return or legal

Constable Deed (Dated and Noterized on September 4, 2018 and never recorded a Officer’s Return or a

Deed awarded on September 4, 2018. These document are missing from the closed (May 15, 2018)

mock docket.

 

Sandy Hundy  false claim she filed an Affidavit, Notice of Foreclosure Sale (No attached documents to

support the Affidavit not filed stamp) the Affidavit appears four days after the closed mock docket

indicated she was served The Order of Sale on September 10, 2018.

 

Sandy Hundy never issued Notice of Foreclosure Sale and foreclosure records do not support  the sale

on September 4, 2018.  Not recorded on the closed mock docket.

 

Sandy Hundy and Sipra S. Boyd never signed a single legal document as an attorney on the mock docket.

 

Not a single legal document was signed by an attorney of record nor a judge with jurisdiction in a legally

file lawsuit.

Legends Texas Homeowners Association Inc., Homestead fraud using fake Abstract of Judgment changing the name of the HOA and filed it with Denton County Tax Assessor – Collector. 

Fake law suit and petition using Denton County District Court, Mock Docket in 442nd District Court and fake Motion for Nunc Pro Tunc Oral Hearing, using a Cause No. for Tax Suit filed in 2007 never served nor closed. 

The Homestead Theft Scam:

The Role played by Legends Texas Homeowners Association Inc., President, the Board, Classic Property Management and Roberts Markel Weinberg Butler Hailey PC a debt collection company:

Legends Texas Homeowners Association Inc., President Robert Umphred and the Board never hired an attorney to file and pay an Opening Filing Fee on December 3, 2015 in the 442nd District Court of Denton County Texas. 

Legends Texas Homeowners Association Inc., used Roberts Markel Weinberg Butler Hailey PC a debt collection company to schedule a separate homeowners monthly meeting on October 17, 2017, excluding the other homeowners from attending and pretending a lawsuit was filed.  (See Video) the secretary is not taking minutes for the meeting.  The homeowners were in the lobby of the hotel waiting for the meeting to start.

Legends Texas Homeowners Association Inc., used Classic Property Management to alter my name as The owner of my home by adding an initial after my first name making it appear to represent my middle name. 

The HOA used this tactic of (Exact Name Match) issue to prevent my claim as owner and resident of my home.  The HOA pretended to file a lawsuit using a Mock Docket using a Cause No. in the 442nd District Court of Denton County, Texas with its law firm listed as Roberts Markel Weinberg Butler Hailey PC a debt collection company, without filing a single legal document.

Legends Texas Homeowners Association Inc., role in this homestead fraud was to cover-up the 2007 Tax Suit filed by attorney George C. Scherer representing Lewisville School District requested by Denton County Tax Assessor – Collector without the knowledge of Lewisville School District and knowing my taxes were paid by my mortgage from my payments.  Attorney George C. Scherer never served the lawsuit and the docket indicates we filed documents stating we were in the military and our address was unknown he also removed our middle name as plaintiff.

Denton County Tax Assessor – Collector received a fraudulent Abstract of Judgment from a Nunc Pro Tunc, Oral Hearing dated May 15, 2018 sent by Legends Texas Homeowners Association Inc., to pretending it was received from Denton County District Court Clerk.  The HOA altered its name as the filing party, missing name of attorney, missing title of Abstract of Judgment, missing plaintiff recovered judgment against defendant, missing County Clerk filing and certification.  Listing a creditor and debtor as parties to the judgment not a plaintiff and defendant.

Using (Exact Name Match) changes between the courts and state agencies to take Homestead homes Denton County Tax Assessor – Collector, Denton Central Appraisal District, Roberts Markel Weinberg Butler Hailey PC a debt collection company, Classic Property Management, Legends Texas Homeowners Association Inc., Denton County District Court Clerk, Denton County Clerk.  All parties pretending to file law suits to take my home protected by homestead.

Fraudulent records used to take homes:

Denton County Tax Assessor – Collector using altered name of homeowner records and used attorney George C. Scherer to file a false Lewisville ISD 2007 Tax Suit, with fraudulent document changing my name as owner.

March 2, 2015, 442nd District Court Judge Tiffany Haertling of Denton County, Texas, used fraudulent Substitute service in the false court of 442ND with a fraudulent typed District Clerk filing.  Using instructions to use the original Citation and Petition before December 3, 2018.  Using a Cause no. She is assinging to the 2007 Tax Suit for Lewisville ISD.  

Roberts Markel Weinberg Butler Hailey PC a debt collection company without a lawsuit pretending to Be a law firm sent Denton County Tax Assessor – Collector fraudulent Affidavit of Notice After Foreclosure Sale.  Without Notice of Foreclosure Sale.  This is a cover-up for the Order of Sale at the Oral Hearing for 2007 Tax Suit.

Denton Central Appraisal District Connie Bradshaw and Pam Pockrus altering my 2018 Certified Appraisal Roll refusing to issue my 2018 Certified Appraisal Roll listing me as the owner of my home listed as Homestead approved dated after August 3, 2018.  They list Kevin Christopher Alaimo as The owner of my property without a register Deed.

Denton County Tax Assessor – Collector, Debbie Mullen stated she can’t explain who authorized Attorney George C. Scherer to file the 2007 Lewisville ISD Tax Suit, also she is not authorized to Remove it.  She also stated she can not explain who sent the Affidavit on notice after the foreclosure Sale without Notice of Foreclosure.  She could not explain who sent the Abstract Judgment,  She said She could not explain who listed Kevin Christopher Alaimo as the owner of my home nor who Filed the Constable Deed when there is no attempt to take my deed. She could not explain why There is a claim that my home was sold at a foreclosure sale and Order of Sale for Tax Suit Seizure Constable Sale without a legally file lawsuit.  She stated she could not help identify who can help me, This is her excuse to leave illegal document on their database.

Without a registered deed Kevin Christopher Alaimo is attempting to file a homestead claim on my home, without a lawsuit filed against my home.  He is filing a fraudulent Constable Deed with the Denton County Tax Assessor – Collector.  He is attempting to take our CoServ active account by Placing a deposit on my electric and gas account, CoServ instructed us to stop paying our Gas and electric account.  Kevin Christopher Alaimo is attempting to take my home using homestead Laws of an abandon home not a legal law suit with the assistance of Denton County Tax Assessor – Collector, assessor’s office, court clerks
