After seeing a flyer for windows in the El Paso, Texas area I called the company and arranged to see their representative on March 24, 2010. During the presentation of the companies product the representative told me that several customers have paid-off their windows entirely by referrals.
I asked how this was possible and the representative told me Desert King Windows allows referrals from customers. As many as he or she chooses to refer. The representative told me that one of his customers had just paid off his entire bill by referals only.
Considering my entire bill after purchase I figured I needed to refer forty three potential buyers. The representative gave me a Desert King Windows letter stating, "By giving them the name of someone who will allow us to come out and show our windows, we will pay you $100.00 cash for each name, we will also give them $100.00 for taking the time to let us come out. They must be a home owner, no renters, and windows at least 10 years old. There is no obligation to buy. This is our way of saying thanks, we will talk to you soon."
After reading the letter and taking the Desert King Windows representative's word, I decided to purchase eight windows for a total cost of $4229.00 This is how I determined how many potential customers I had to recommend in order to pay for my entire purchase.
A few days after I signed my purchase agreement I received an envelope from Desert King Windows. Inside I found a check for $25.00, and a letter on Desert King Windows letter head signed by Trina Linden, Referral Promotions Manager.
The letter stated, "Thank you for choosing Desrt King Windows for your home improvement project. I have enclosed your promotional gift as our way of saying thank you for allowing us to demonstrate our product to you.
Now...want to make more money? Here's how:
Just fill out the enclosed card with someone whom you know that would also allow us to show our windows to them, and we will pay you $100.00. In fact, you're not the only one who benefits; the person you refer us to also get's $100.00! Keep in mind this is whether they buy or not; all they have to do is see one of our wondow demonstations.
You don't have to stop there either. Desert King Windows will pay you $100.00 dollars for as many names as you would like to refer. You can send in as many names as you want, make as much money as you want that's up to you!

We look forward to hearing from you soon."
I began to gather names of friends, relatives, and co-workers. I submitted nine names and was told they had only made contact with five of my referrals and only paid me for five referrals.
I now have a $3,500.00 +/- bill I must pay out of my own pocket that I wouldn't have committed too if this referral pitch wasn't a factor. I made the purchase believing what the nice-man was telling as he presented his product to me.
Are there any legal actions I can take against such horrid false business practices? Please advise.

The rip off was created when the representatives told me I can pay off my entire purchase solely on referrals. I submit five names, and I am credited for five names. Desert Kind Windows interviewed nine referrals and only paid for five. Referral promotions manager, Triny Linden told me they will no longer honor any of my referrals unless the potential customers purchase their product. This statement and refusal to pay me additional referral fees is a complete contradiction to the original verbal and written statements given to me prior to the purchase of my windows. I clearly state on my complaint that Ms. Linden has refused to accept any of my referrals if those referrals do not purchase the product. There statements to me clearly indicate in writing that Desert King Windows will pay $100. to any potential customer whether that potential customer purchases the product or not, and will pay me $100. whether the product was purchased or not. This is the basis of my legal action. This issue was clearly stated on my original report. I have their written statements on their company letter head signed by Ms. Linden stating the aforementioned facts.

I have to agree with Robert on this. How is it that you were ripped off? From your own description of the terms of the agreement, they did everything they were supposed to do (plus $25).
You referred five people "that would allow [the company] to show [their] windows to them." $500 was deducted from your bill, so what's the problem?
Don't waste any time or money trying to take any legal action. Save your cash for your window bill.

You get with a company that gives you a $100 for every referal you give them. So you go with the windows thinking that you can give them 43 names and "pay" for your windows. So what do you do, you give them a list of 9 names. Umm...you need 43 and give them 9. They were able to make contact with 5 and paid you $500. So exactly where is the problem with THEM again?
If you want to take legal action, perhaps take it against the 4 of the nine who they couldn't contact. After all you took the time out to write their names down and they didn't have the courtesy to listen to the sales pitch to help you pay for your windows.
The only other advise is come up with about another 38 names who promise to have the people come out and let them give their sales presentation. Perhaps even have the people you are refering sign a document so that if they don't follow through you can take them to court. But why stop there, why not come up with more names. After all if you get more than 43 you can actually make a little extra.
