So.......  I went to Detroit 2 Auto to buy a truck because they told me they would be able to find me what I wanted.  I told them I wanted a newer body style Dodge Durango that had very low miles. Well they found me the perfect truck and I loved it.  Originally they told me I would only have to put $2000 down and that everything else would be included in the payment.  Well that didn't happen.  They got the truck from some auction and then required me to put another $2500 down on the truck.  Everything was fine, we paid on time for 6 months until one day my husband didn't receive his paycheck.  Well when he finally received it about 10 days later, Detroit 2 Auto decided to repo the truck.  I think all together I was exactly 17 days late.  I went up there the same day they repo'd the truck to make the payment and see how much it was to get the truck back, and I was told that i needed to pay the remaining balance of the truck. The balance was $7300.00 .  Sorry I didn't have that much money just sitting around to buy the truck out right. If I did I would of never had a payment to begin with.  Anyways.......  Needless to say they never tried to work anything out with me.  So I had my mother take me up there to get my stuff and to see if there was anything else I could possibly do.  The finance guy got in a tiff with my mother and decided to call the cops on her.  So she retaliated and called the cops on him and it was nothing but drama......  Well after the cops showed up they advised me to just give this crappy car dealership the keys to the truck so I could get my stuff out.  It took Detroit 2 Auto 3 days to finally give me all of my stuff.  At that point I was trying to contact a lawyer, I tried to get through to Fox 2 news, channel 7, channel 4.  Anything at all.  I even filled out a report with BBB.  Nothing ever came out of any of it.  So now I'm filling this out because I was trying to see where exactly they auctioned off my vehicle to find out how much they received.  Because I've never gotten any other paperwork saying I owed them money or maybe they owed me money or who knows.  So if you have read this  DO NOT BUY A CAR OR TRUCK OR ANYTHING FROM THIS 2 BIT DEALERSHIP!!  I don't want anyone to have to go through what I did.  It was stressful and just plain exhausting.  And HONESTLY THEY DON'T DESERVE ANYONE'S BUSINESS.

There is a no tolerance policy which we tell every customer when purchasing the vehicle.  Also, it is the bank that repos cars, not Detroit 2 Auto.  If someone disappears, can not be reached, and does not notify the bank (lending institution) when they are paying or why they are paying late, then of course the bank will come get your car.  The entire point of our program is to BUILD credit, making payments on time will help do this.  More importantly as of April 2012 Detroit 2 Auto in Redford is under new ownership and management.  We are very concerned with customer satisfaction and are here to help.  Please call either Mario or Andrew (313) 535-9280 during business hours so we can put out any fires or problems and customer has whatsoever.  Thanks!

you owed money on a vehicle. you admited to being 2 and a half weeks late on your payment. There is no ripoff here. They took your car because you didnt pay for 2 and a half weeks.  It seems to me that you have an inability to pay bills on time. The finance company does not need to give you extended time to make a payment.  here is some basic info for you.

As per the UCC, repossession is allowed and permitted as long as it is peaceful.

did you try talking to them and letting them know you would be late and work something out. that helps sometimes ultimatley they want your money not the vehicle back. here is the law for michigan

 

Possession After Default Without Breach of Peace Unless otherwise agreed,  secured party has, on default, right to take possession of the collateral. In taking possession a secured party may proceed without judicial process, only if this can be done without breach of the peace. If not, a legal action may proceed. Michigan UCC MCL 440-9503
Right to Redeem At any time before secured party has disposed of collateral or entered into a contract for disposition under section 440-9504 or before discharge under section 440-9505, debtor or any other secured party may, unless otherwise agreed in writing after default, redeem the collateral by tendering fulfillment of all obligations secured by collateral, expenses reasonably incurred by secured party in retaking, holding and preparing collateral for disposition, arranging for sale, and to extent provided in agreement and not prohibited by law, reasonable attorneys' fees and legal expenses. Michigan UCC MCL 440-9506
Compulsory Sale Under the Uniform Commercial code, where debtor has paid 60% of the cash price in case of a purchase money security interest in consumer goods, or 60% of the loan in case of another security interest in consumer goods, secured party who has taken possession of vehicle must sell vehicle at either public or private proceedings and must give reasonable notice of time and place of any public sale or of time after which any private sale is to be made, unless debtor has signed, after default, a statement renouncing or modifying these rights. 9-506

Acceptance and Satisfaction Where debtor has paid less than 60% of the cash price of cosumer loan, secured party in possession may, after default, propose to retain the collateral in satisfaction of the obligation. Written notice of proposal must be sent to debtor. If debtor or other person entitled to receive notice objects in writing within twenty one days after notice sent, secured party must dispose of the vehicle by sale under Section 440-9504 of the Uniform Commercial Code. Michigan UCC MCL 440-9505

 

 really you have no case that 7300 dollars was 60% of the loan which they require to meet there obligations on the loan to satisfaction.

talk to an attorney, find out the repossession rights and laws for your state.

if nothing else you could have filed bankruptcy (13) they would have to give the vehicle back.

there is a blessing in all of this for you somehow. If you have to get legal aid to refer an attorney for a free consultation.
