Regarding Account # 11024909054226 (Account of Sarah L. Phillips of $98.00)

On approx. May 9, 2013, I Joseph Phillips talked with the  General Mgr. of RGS Financial at the Richardson, TX office and informed Dheer Sukhani that I wanted to get a written agreement that if I paid my wife's bill of $98.00 that this item would be completely deleted from her credit file.  This item was paid the same day on about May 9, 2013.  His response was that he was unable to put anything in  writing but verbally promised (which promise is on a tape recorder) that he, Mr. Sukhani woud see to it that this item got deleted from Sarah Phillips Experian credit file once full payment was made.  I now have a receipt of this bill being paid in full which I had to pay an extra $9.00, an illegal bogus charge to just get this bill paid to them.  The problem I have is this:  My attorney and financial advisor, disputed this account at the Experian credit bureaus for Sarah Philips only to get Experian to validate this account recently.    This means that RGS validiated this account as still owing after the bill was paid in full.  The whole substance of the verbal agreement was to pay the debt to have the account deleted, not again validated by RGS as still owing, so it stays on my wife's credit report as a negative item, thus dragging her score down.  This is the only negative on her report as she pays her bills on time; this bill she thought was paid, but somehow ended up as a collection as a simple oversight.   The results of the recent dispute on the Experian  report date of May 15, 2013 says that this item still remains showing as a balance due. This means that RGS Financial renegged on their agreeement. 

There are 22 complaints filed at the Better Business Bureau currently with this company and this company currently has a C+ rating with the BBB  which is pathetic even though their website reads as follows:

"At RGS we have zero tolerance for unfair and impolite business.  We want to make sure we are never confused with other/agencies in our industry that might engage in unethical business practices."

So even  their website is further proof of their deception and lies as Chris Pruitt, a high ranking member in the company refuses to return calls or discuss issues on a timely basis or change the bad image this company has by trying to straighten out his subordinates deceptive ways of doing business.

Renegging on a verbal agreement simply because the manager of RGS Financial in Richardson, Texas didn't have the integrity or good service of  putting the agreement in writing through an email is very unethical when one deceives customers into payment through deception and says lies like, "we can't put anything in writing, but you can trust me." 

It's complete nonsense when the General Manager says  that it takes 60-90 days to get items deleted from a credit report as the collection agencies lie and purport.   It's a fact if there is something in writing from the creditor with heir letter head and contact information & instruction to the credit bureau  to delete the negative entry, through "rapid rescore", the item can be deleted off credit reports  in just a few days and the score can change accordingly in just a few days.  This is a hidden secret that the collection agencies know and pretend to not know. But when you can't get anything in writing from a collection agency,  you can't do repaid rescore.   This is factual and goes on all the time such quick deletions, so I'm not waiting to get the run around anymore from this company, nor am I listening to any more of their lies.   

I have instructed my attorney to do the following in addition as I don't have the time to deal with this as his instructions are to:  

(1)  File a complaint with the BBB

(2)  File a complaint with the State Attorney's Office General in Texas

(3)  File a complaint with the Federal Trade Commission

(4)  File a complaint of specific performance and monetary damages for breach of agreement and deceptive trade practices under the FDCPA.
