On 2 Nov 09 I wired a $15000 deposit to Compass Bank into the account of Diamond Motorsports located in Scottsdale, AZ for a 2005 Corvette Convertible. I was sent a contract but it was not in the proper attachment form therefore is was never printed and completed.
On 4 Nov 09 I decided not to go through with the transaction due to job stability issues. I notified my salesman, Johnpaul, at approximately 8am MST/ 4 Nov 09 that I needed a refund of my money.
After repeated conversations on the phone and through email with Johnpaul, the sales man, and Craig the owner I have recieved no refund and am getting the run around from Johnpaul regarding Craig's avaliablity to go to Compass Bank and sign the paper to return my money. I called the manager at the bank and she confirmed that Craig simply needs to come in and sign on the dotted line, then they will return the wire to my credit union.
It has no been 9 business days since I requested the refund. I have contacted action 12 news in Phoenix, Senator McCain's office and am contacting the State Attorney Generals office if the wire is not returned by end of day today.
When I told Johnpaul what I had done and what I intended to do should my money not be returned by close of business today he replied that if I made threats this would become a civil matter and I would lose as all out of state deposits are no refundable. This guy has some nerve holding $15000 of my money without delivering any goods or services then saying he is going to pursue civil action against me.
DO NOT MESS WITH THESE GUYS OR THIS DEALERSHIP. IT WILL NOT END WELL.

I recieved a check for the full amount of my deposit today from Diamond Motor Sports. While it did take a little longer than I thought it should take the bottom line is that the business and John Paul did the right thing. Thank you to DMS.

I'm kind of surprised that a dealership would want to risk their reputation for something this stupid. You didn't sign the purchase agreement. I'm not quite sure what grounds they are withholding your funds on.
But why did you wire funds before you had signed a purchase order/agreement? That was the only thing that didn't quite make sense. And what is their threat about suing you for a civil matter? If they are thinking about defamation of character, then they are sadly mistaking. This report wouldn't even come close to being grounds for a lawsuit.
Obviously, you ticked them off and they want to see you sweat. $15000 is a lot of money.
