Thank you for your response and I hope that you please can help me or send me in the right direction. I am at my wits end and I don't know where else I can go to get help and I think the company that I bought the laptop form is aware of this and is playing games with me. All I want is my money back and to just end this nightmare. Also I am losing faith in Ebay cause I am not getting any help and this company just keeps getting away with lying and not sending the refund.
I bought a laptop off of ebay in November and when I received it, it did not work. I would not hold its charge. So I asked a friend and they said that that was not good and there could be a number of things wrong with it. I also showed my Mom and Sister and plugged it in overnight by then it should of charged. It did not. I emailed Dimosol and said I want a refund because this should have been working and that I was not sure what was wrong and if I sent it back and got it back it would have had the same problem, pluse all the shipping and duty charges.
They asked what was wrong and that give them a chance but again there was the shipping, taxes and what if its not working again problems. So I said I would just like a refund. I shipped it back and then asked for my money. They said the sent it to me. But after bugging them and bugging them and calling and leaving messages I was not getting anywhere. Finally I got a response. I have atached all the emails that I kept with the responses what was said. Finally they said that the cheque has been mailed and that I should be getting it. I waited and two months later no cheque and numberous emails again no response finally the responded and said the cheque was cashed.. funny I never received no cheque to cash and I asked where the proof of it being sent etc. I can prove I never received anything. No, US cheque was ever cashed to my bank account.
Is this the game they play that they send the cheque and oh look you cashed it no proof guess we sent it. Sorry I don't work that way. and if you want I will get my bank to write you a letter saying that no monies were ever cashed with that amount. I think this is what this company does and that they think there is no proof. I'm sorry but fraud is not a good thing. All I want is my money refunded and then I will leave them alone. I thought they were a fair company and had integruty but I guess not. The only time the responded finally is when I sent them an email from a friends email address.
The funny thing is when you buy something from ebay you can put a response about the company. For some reason I did not have that option can you please tell me why? I am thinking I am going to the Better Business Bureau maybe they can help. I'm sorry but I don't know what else to do. I might have to call the sherriffs office maybe in Atlanta. Please help me get my refund back and also to get the word out what a horrible company these people are to deal with. I have never had these problems on ebay before and am losing faith in ebay because of it.

What repsonse on ebay about hiding? I sent you a check, I have since found out it was cashed. I am waiting for my bank to get me a copy of it from the bank in Canada to see who cashed it. Sending me 50s e-mails is not going to help this situation.

I remember this woman contacting us about the laptop she bought from us on ebay.
As she stated in her report she "bought a laptop off of ebay in November and when I received it, it did not work. It would not hold its charge." Her "expert" friend and her mother and sister (also computer experts) also told her something was wrong. The problem was her battery was dead which is why it would not hold a charge. I also see in her report that she failed to tell you all that the laptop worked fine except for the fact that the battery did not hold a charge. She did ship it back to us (unauthorized) and DEMANDED a refund. She would also contact us at least 50 times a day (no joke) either via email or phone with VERY, very foul and obscene language (which she elected to delete from the emails she reproduced for you all here).
I had no problem whatsoever working with her on her issue. The ONLY issue was her battery was dead. If you look at the terms of ALL of our auctions it CLEARLY states that "We do not test the battery that comes with this laptop. We do not guarantee that it will even hold a charge. Please keep in mind it might be dead." (copied/pasted from the actual action she bid on). She read this (or should have) and agreed to it by bidding on my item. It wasn't hidden away in very very small print at the bottom of the auction description. It is written clearly in red (to stand out) at the top of the "terms" section. So she knew that the battery that she was getting with the laptop she was bidding on might be dead.
Regardless, we would have gladly sent her a replacement battery which would have fixed her problem (saving her the cost of return shipment). We do not have that many bad battery issues (fortunately), and don't mind ignoring our own policy and sending out a replacement when they do occur. However, instead she sent the entire laptop back to us (once again unauthorized) where we tested it. It worked 100%, and as suspected the battery was dead.
Anyway, all this time she is calling and emailing demanding a refund which in the terms of sale that she agreed to by bidding on our item clearly states that we do not give refunds (and in the rare situation when we do , charge a 30% restocking fee - more on that in a minute).
I finally decided that I did not want her business (I don't say that often - actually only one other time in the 15 years I have been selling laptops). I have the right as a business owner to refuse service. I had had enough of the obscene threats and language and authorized our accounting department to give her a full refund (once again ignoring the terms that she agreed to by bidding on my laptop). We sent her a check, and to this day, can provide proof that it was signed for by someone at her address, and proof that it was cashed. We have even go so far as to try to track who has cashed her check via bank to bank tracking, etc.
The bottom line is this. She saw our auction, she saw that the battery might be dead an she could not get a refund if she didn't like it. There were probably 1000 other laptops that were the exact same specifications as the one she bought from us available at the same time our was up. If she didn't like our terms she could have very easily bid on one of my competitors. She bought ours and had a problem with the battery which we would have GLADLY replaced had she not started with obscene threats and false accusations. If you are reading this Charlene from Edmonton, Alberta as the old saying goes "you get more bees with honey than vinegar. Next time try being a little nicer. It goes a very long way.
