In march of 05, the school i was attending only for a short time had closed the doors on all the students without any warning. (BCTI) Everett, WA. we were told to contact the us department of education to wipe out our student loans. Now i am getting threatening phone calls from Direct loans that say they represent the us department of education. I told them i am not paying for something i didn't receive and they said if i did not pay for this loan then they would attach wages, taxes and report it on my credit. well, they did sure enough it is on my report. I am just fired up. i asked the person from direct loans if they would pay for something they never received and all i got was silence. so please if there is anyone else going through this problem then contact me. i know that there was alot of disappointed students. this is not fair when we were told that our loans would be taken care of and now i am being threatened.

if you want this loan to go away 1st calm down and read what I got from the DEPT OF ED website.

If you believe you do not owe, should not have to pay, are being charged the wrong amount for, or are suffering financial hardship because of a student loan, see below for what to do:

I believe I have no obligation to repay the student loan because:

I am not the person whose name and/or SSN is shown as liable for this loan, and I neither received the loan nor agreed to repay this loan for another
I did not sign a promissory note for this loan
This loan was previously paid in full or discharged
The loan was discharged in bankruptcy
I am disabled
The student for whom the loan was borrowed is deceased
The school I attended closed
I only attended the school for a short period of time and did not complete the program
I did not have a high school diploma or GED when I enrolled in the school
I was not yet 18 years old when I signed for the loan
I was not able to benefit from the education I received
The statute of limitation for collecting this loan has passed
I believe I am being charged the wrong amount for the student loan because:

The balance is higher than what I borrowed
I have made payments on this loan that have not been credited to the balance
I should not have been charged interest because I was not aware that I owed this loan
I only attended the school for a short period of time, and shouldn't have to pay back the full amount
The defaulted student loan that I owe is causing me financial hardship because:

My federal tax refund has been offset
My social security or other Federal stipend is being offset
My wages are being garnished
The agency that holds my loan is demanding unreasonably high payments

Identity and Unauthorized Signature Disputes

Find the statement below that most accurately describes your situation, and then follow the instructions for resolving that problem:

The loan records I have seen show my SSN, but the name shown as borrower is not my name, and I did not sign a promissory note for this loan.

In order to show that you are not person who received this loan, you will be required to show Department representatives proof that you are not the individual whom these records show to be the borrower. This evidence typically includes samples of your signature and photocopies of the following:

Your Social Security Card
Your Driver's license or government-issued ID card
Your Passport or Birth Certificate
The loan records I have seen show a name that is the same as mine, but the SSN shown as that of the borrower is not my SSN, and I did not sign a promissory note for this loan.

In order to show that you are not person who received this loan, you will be required to show Department representatives proof that you are not the individual whom these records show to be the borrower. This evidence typically includes samples of your signature and photocopies of the following:

This loan has my name and SSN, but I did not sign a promissory note for this loan.

To prove that the promissory note was forged, you will be required to submit examples of your signature from around the time that the loan was made (e.g., from tax returns for that year, driver's licenses issued at that time, cancelled checks that you wrote at that time). Alternatively, you can provide proof that you could not have attended the school for which the loan was made (e.g., proof that you were living, employed or enrolled in school elsewhere at that time.) Lastly, if you are unable to provide such proof, you can provide an report from an independent handwriting expert to support your claim

Disability

A student loan can be discharged (forgiven) if the borrower becomes totally and permanently disabled. This means a physician (either an M.D. or a D.O.) must certify that the borrower suffers from a medical condition or impairment that prevents the borrower from working in any capacity, and that this condition is expected to continue indefinitely or cause death. It is important to note that:

you may receive Social Security, VA or other disability benefits and still not meet the definition of total and permanent disability that applies to student loan discharges.
you do not qualify for discharge if the medical condition or impairment existed at the time you applied for the loan, unless after that time, the condition has significantly deteriorated and then became disabling. In other words, an individual who was already totally and permanently disabled when he or she applied for a loan cannot have that loan discharged for that condition.
Note that PLUS loans are not dischargeable on the basis of the student's disability.

What to Do:

If you believe you qualify for, and wish to receive, a disability discharge, you and your doctor must complete, and sign, a discharge application form. You can request this form from the party that holds your loan, or you can download it now.
Check a recent demand letter or bill for this loan; if the address to which you are requested to send payment is the National Payment Center in Greenville, TX, you should submit your completed form to:

You may request a copy of this discharge application form by calling 1-800-621-3115 or download a copy here. Note: in order to guard against fraud, the U.S. Department of Education (ED) will contact your doctor directly to confirm the nature and severity of your disability if you apply for a disability discharge. In addition, ED may look for evidence that you are gainfully employed.

Death

IA student loan can be discharged if the borrower of a student loan dies, or, in the case of a PLUS loan, either the parent borrower or the student for whose education the loan was borrowed dies.

What to Do:

Send an original or certified copy of the death certificate (which must bear the official seal of the office that issues the record) to the party that holds the loan.
Check a recent demand letter or bill for this loan; if the address to which you are requested to send payment is the National Payment Center in Greenville, TX, you should submit this documentation to:

Closed School

You may be eligible to have your loan discharged, if you did not complete the program of study and either of the following is true:

the school closed while you were attending, or
the school closed within ninety days after you withdrew from the school

You must complete and submit a closed school discharge application form. You can request this form from the agency that holds your loan, or you can download it now. Check a recent demand letter or bill for this loan; if the address to which you are requested to send payment is the National Payment Center in Greenville, TX, you should submit your completed form to:
