Ditech totally mis represented my mortgage contract. As far as I am concerned this is "theft by deception"!. They would not give me a copy of the contract prior to closing, blocking my right to attorney review. Closed on March 1, 2007, account funded, on the 6th. I was informed in writing that no payments is due until May 1st 2007. They knew the cost of taxes and insurance and held money in escrow. On May 1st they took all of my escrow and paid the interest for the first 2 months. Never said a word about it for a year. Never a word about escrow being short for taxes and insurance. April 2008, they raised my payment to cover the escrow rearage and penalties they charged. Since they already know my income and my current situation, they know I will have trouble making this payment, as they counted on. This creats a snow ball effect which in 6 months we wont be able to get out from under. This is there plan and what they do!
Where I need your help is to let everyone you know what Ditech is doing. I will be making a costomer awarness tape and putting it on Utube. As a former real estate agent, I will use my resourses and notify every association across the country. All will be invited to Ripoffreport.com to read before they sign. This is what we all need to do. We need to put the word on the street. Hang a banner over the local freeway at night... no one needs to know your name.

wake up this company / gmac etc are the worst company in the world if i should you evidence and let you nhear the taped message form one of their employees you would drop your teeth gmac/ balboa screwed up my escrow lost my files on taxes etc that they were to pay it cause gmac to attempt forclosure on me and resulted in a five yr lawsuit with them still saying they did noting wrong bert check to see if balboa is the comp handleing your escrow account they may tell you no they are but insist that they tell you if it is balboa thats where you probs start oh and balboa is owned by country wide go figure that if you read my story guy you may find contacts links for me gmac deaf dumb and blind

You mention you are a former real estate agent, so you have knowledge and understanding of real estate law - I hope. Why in the world would you ever have signed your loan documents if you were not given a copy of your "contract" ahead of time? And the fact that you are an experienced agent and refer to your disclosures (GFE, TIL, HUD, NOTE, etc.) as a "contract" makes your story highly unbelievable.
You're taking this personal - like the individual person that you were working with has some sort of a vested interest in screwing you over so they can create a financial hardship for you. Come on now - you're brighter than that. How in the world would that individual person gain from taking such an action? I'm not saying that a mistake was not made with regards to your escrow and your account - it happens all the time with all lenders, but your representation of the lenders intentions and the facts clearly needs to be polished up - alot. Before you rant and rave and slander a good companies name on a website like this, you should really have a much better understanding of what really happened - especially since you represent yourself as an agent. I really hope you never made your Utube video - how embarassing.
